Hello all,

I'm filling out the I-134 and im not quite sure about question 10 so I thought I would ask here.

The question reads...."I have submitted a visa petition(s) to the U.S. Citizenship and Immigration Services on behalf of the following person(s)."

I know I have to list my finacee here but I had submited a prior I-129 petition a few years back for a prior relationship but the marriage never happened. So do I have to list that petition filing too? I figure I do but how I so I fill out the relationship part....EX fiancee?

Thanks

I think that question is asked to determine how many people you are planning to co-sponsor, so you do not have to list your ex fiancee in that section since the Affidavit of support you are filling in now does not concern the ex-fiancee. And you mentioned that you submitted that older petition a few YEARS back, so I don't think you need to include that person on your I-134 now.

Visa Journey completed, but we are still here to provide support! :)

Thanks....I just thought I had read some where that your had to list prior petitions there. So next questions then do I have to list all my fiancees kids there too? I have them listed under section three already as children that will accompany her so I think not but I just want to make sure I get it right!

Yes, you have to list all your current fiancee's kids if you also filed petitions on their behalf (K-2 visa) and if they are coming with your fiancee to the USA. So you list your fiancee and your fiancee's kids on the lines provided in #10. You will be responsible for supporting your fiancee's kids when they come to the USA with her as well, so that is why it is necessary to write their names here as well, since you filed petitions for them also.

Thanks but there are only two lines provided and one is used for my fiancee of course. So that leaves only one left and she has three kids. Also they are not my step children yet so what would I call there relationship to me??

You can add additional paper and write "see attached" if you need to for lack of space. Their relationship to you would be Fiancee's daughter/son.

You need to provide a separate I-134 for each of her children. Line 10, for her, answer "(her name) and (childrens names) with this petition" repaeat this for each of the children's I-134s. The instruction say each I-134 must have supporting documents (you can use the same ones) but in our case, they said "Is it all the same?" When I answered yes they detached all the supporting documents and gave them back.

Regarding previous fiancees, I think the reason for the question is to determine if you are supporting anyone else "back home". In your case that is not true, HOWEVER it is always dangerous to try and read "intent" into the rules. Best to answer "yes" and explain the petition or visa was canceled or you were divorced or something to indicate this person is no longer a dependent.
