Hey Everyone

I am currently over in the US on a Journalism (I) visa, and have been here for the last 3 years.

Within that time, i met someone and we now want to get married - i just need to know about all the legal red tape! I am from the UK, do i need to go and get a Fiance Visa and go that route? Or can we get married and then just apply for the adjustment of status?

I just need to know the correct route to take with it all.

First, you have to check to see if your visa allows status change (some do not, I do not know the status of yours).

Then, if you can do change status, get married, and apply for the AOS.

The guides up top will guide you.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, you can adjust status from I visa. I am doing that, my interview is less then a month from now.

Read all the guidelines very carefuly (as a journalist, I know you sure will :) ) and you will be able to do the paperwork yourself. I sent mine in july and so far it has been a smooth process.

24 July 2008 - Checks cashed, NOA sent for I-485, I-130, I-765 and I-131

28 July 2008 - NOA received in mail, applied for State ID

29 July 2008 - Case viewable online

04 Aug 2008 - NOA for Biometrics (sent July 30)

20 Aug 2008 - Biometrics done

23 Aug 2008 - Received State ID card, valid for 4 years

05 Sep 2008 - Received new corrected State ID

24 Sep 2008 - AP and EAD approved

04 Oct 2008 - EAD in the mail

05 Oct 2008 - AP in the mail, applied for SSN

07 Oct 2008 - Job interview

10 Oct 2008 - First day at work

Is your interview the final part of the process for you? Do have a ny idea what the interview will involve.

The process is exactly the same as for those adjusting from tourist visa or VWP. You will be filing I-130 with I-485, as well as for travel and work permits if you need them. Interview is the final stage of conditional green card process, removing of conditions comes later.

You will be sending the package to Chicago, but depending of your local office (you can find it by the zip code on USCIS web site) will be determined the time of your interview. You will definitely have one since you are adjusting this way. For interview info, read the reviews on VJ. What matters now is that you know you have to send I-130 application for family member that your spouse will be filing, along with your application I-485 to adjust status, and all the following forms that you will find in the instructions for those two.

Just read the guides for adjusting withing US.
