K1 Visa case pending, what can happen if ask for Turis Visa?

Hello to all,

We have our K1 case pending (long way to go), I missing my love so bad and I can't go there at this moment so

I'm being thinking to apply here for Guest Visa (Tourist Visa) so she can come to me while

her case is pending and get back when it's completed.

What you think about? Any thoughts?

I understand they will think she will stay here as illegal immigrant, but what is the reason for her to stay illegally if her

case is pending and she cam come back.

If they deny her Tourist visa how bad is this will be when we to the interview point?

Nothing bad will happen if you try. Your chance of rejection is 99.999999% It is nearly impossible for a young woman from Ukraine to obtain a tourist visa to the USA unless she can show rock solid evidence (like a business, high paying job and ownership of property) that she will return to Ukraine. The fact that she is the benficiary of a I-129f will surely get you shot down as she has demonstrated a desire to relocate to the USA. Again, no harm in trying. Fees are not refundable and it could take nearly as long as the K-1 visa to get your rejection. A couple years before we met, Alla tried to get a visa to attend an exhibition in New York related to her job. She owns an apartment in Donetsk, had a good job, two minor sons who would be remaining in Ukraine and they flatly denied her a visa, without even being polite about it, and it took like four months to get the rejection.

I visited Alla 5 times in 6 months, going for as few as 3 days two times. I know you miss her, but it is next to impossible to pull this off. Better to busy yourselves with the K-1 process. Download the packet 3 from the website and get going on those documents now so you can shorten the timeline as much as possible. When you get the chance, go to visit (it is easy for us to go there). It will go quicker than you think (I hope), it did for us and now that time is just a memory and we are together.

By the way, it seems much easier for an older person, especially if they have family in the USA to visit. I know one VJer who got a tourist visa for her mother (5 years unlimited entries) before she got her green card! We are in the process of pursuing one for Alla's mom. I guess a woman over age 65 and retired is less of a risk????

Sorry, forgot to answer your next question.

A denial for the "usual" general reasons will not affect your case. Alla was denied for a B-1 visa (before we even met) and they never had a question about it (we did note this on our application). If she were denied for some disqualifying reason (i.e. criminal, drugs, etc.) then it WOULD affect your application for K-1. Alla got a rejection, but was not "barred" from applying for another visa. She did say she was treated "like a monkey" at the consulate when she applied for the B-1 and for this reason was very nervous about our K-1 interview and was SURE she would be denied again. Our interview for the K-1 was "no questions asked" and she got her visa.

The fact your fiancee has a case in progress will cause them to believe she will NOT return, as she has stated she wishes to relocate to the USA (to marry you) in her "intent" letter you filed with the I-129f

If your fiance meets the requirements to be granted a tourist visa, I say its worth to give it a try! If she has had a tourist visa before, it will make things a lot easier. I was granted a tourist visa while our K-1 was pending, same as a few other alien fiances that I've met here in VJ. I did not have any problems at the POE during my visit with the tourist visa.

The worst that can happen is that she will get denied and you'll loose the $131 fee, if you can afford it, give it a try.

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN

I've been denied a tourist visa four times. Only the last attempt happened while K1 was pending and was denied for exactly that reason. The previous three made no sense whatsoever.

Hopefully the four denials won't have an impact on my K1 visa. Once they let our case out of AP, of course. In which, I suspect, we could be because of the four denials? Etc.

Hate the system, I must say.

Some good advice here. Definitely do NOT take a flyer and apply for a tourist visa though. The K-1 is too important.

I would just add that multiple applications are recorded in the State Department computer system somewhere, and all consular officers have access to this data when reviewing applications. When the K-1 is reviewed, the CO can clearly see the codes corresponding to the reasons for denial. If the code is a "soft hit" for something like suspected fraud, the K-1 could also be denied. Coming to the US as a tourist when you intend shortly to immigrate might constitute suspected fraud. The CO that put the "hit" in the system must be the one to remove it. You won't necessarily be informed of any of this until the interview date, and if your SO is interviewing by herself she could have a VERY difficult time fixing things. I worked through this once myself - and even with knowing the Vice Consul personally and phoning him directly it took 24 hours to fix things.
