Advice regarding marriage here, then moving to Ireland

Hi everyone,

John and I are strongly considering having him fly to the states to get married here in Atlanta, then both of us returning immediately to Ireland to live. Would we be eligible to file for the I-130 Visa after I've lived there for six months or so? And would I still need to show that I'm employable here and can support him if need be?

04/25/2008 - Met online in "Christian Cafe"

Spent ridiculous amounts of time on Skype getting to know each other

06/30/2008 - Flew to Ireland to meet (9 wonderful days together)

08/20/2008 - 2nd Trip to Ireland (6 very short days together)

09/03/2008 - John comes to Atlanta for one week

10/01/2008 - John's 2nd trip to Atlanta for one week

10/29/2008 - Anita's 3rd trip to Ireland for one week

12/20/2008 - John comes to Atlanta for the holidays - 23 AMAZING days!!

02/07/2009 - Anita's 4th trip to Ireland - will be there 4 wonderful weeks for planning

Yes (assuming the consulate accepts I-130's, most do) and Yes an affidavit of support from a qualified sponsor will be required

Yes you'd be elligible to file the I-130 via DCF once you have lived in Ireland for 6 months.

The issue is not if you are employable, but whether you currently ARE employed; you need to show income/ tax which will continue once you move back to the US, which is virtually impossible for DCFers. Your options are to file with assets (house, bank account etc- you;d need three times as much as you'd need income), get a co-sponsor (a family member or friend in the USA who will swear they;'ll take financial responsibility for the beneficiary if neccessary), or, once you have filed the I-130 you can return to the US immeditately and get a job, so by the time the interview rolls around and the I-864 is submitted, you have a US job to support your husband. That last option is dicey though, with the current economy!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks everyone for your responses! It seems like the best route for us at the current time.

Penguin: Thanks again! Yeah, the job thing hasn't been going so well for me, I've been trying to land one since October of 08, no luck so far. We may just have to bank away as much money as possible over that six months, AND try and sell his house there. I already have about $20K in the bank, so we've got a good headstart.

Bluesocks: That is SO good to hear! I will definitely be emailing you with LOTS of questions!

We planned to file DCF here in dublin too. My SO had his flights booked to move here and all. Then we realized that in the current economic crisis, it would be too risky for him to look for work over here and give up his job in the US. We are back to filing for the K1.

FYI- 36,500 people were made unemployed in Ireland in January 2009 alone- really consider how having no job would affect your marriage. I came to the conclusion that this option would be too stressful for us.
