Hi All,

Hope you are doing well waiting for your NOA2... I have a question that I need answered, especially if you filed at the Vermont Service Center...

Here is my story: Before my fiance and I knew about Visa Journey, we hired a lawyer for the K-1 process (everything has been good, he got my petition over at the VSC and now we are waiting for the NOA2). I filed in October... However, I now see that it was a waste of plenty of money and he was being rather untruthful about when we might get our NOA2, He told me I would be approved with Visa on hand by 5 months.... Anyways, BEFORE we filed for the K-1 process my fiance and I had already planned, booked our wedding for JAN 04, 2009.. We had no idea we needed a fiance visa until it was too late. It was such a head ache, we needed to cancel everything, thank the L-rd we didn't loose any money... so I told the lawyer about this, he told me it would take 5 months max and told me that if I booked the wedding for sometime in May that would work out... so I DID... and Now the set wedding date is May 31... Hopefully a miracle happens, BUT if it doesn't then it doesn't I might need to just set a tentative date.. (my vendors are pretty understanding thank the L-rd). This is my plan, if we don't get our NOA2 by the end of February then we need to cancel that May 31 date...However, if we do get approved by/before February 28, how long do you guys think it will take to get the VISA in hand based on the Consulate? (In Sydney, AU)... From March 1 to May 31 it's about three months... does it take longer than three months to get a Visa? Just wondering about this at the moment. ANY information any one can provide will be greatly appreciated.

Looking at your time line, your case is not even scheduled to be looked at till end of April/beginning of May.

So, using the rule of thumb (flowchart), your end of May wedding doesn't look to good.

You may get lucky and time out prior to that. But it seems VCS is slow now.

I would not plan any more wedding plans till after you have the visa in hand :blink:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I gave you your answer.... Look at the flowchart for the K-1....

Time varies depending on a lot of factors.

anywhere from 1 month to several months. (one person has been in AP for one year at the embassy level....)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

depends on how long it takes NVC to clear the file and how backlogged the consulate is...

typical is 2-4 weeks for NVC to get it to consulate (some sooner, some later)...

then it is up to the alien applicant, as the process is applicant driven once the information packet is sent....

You or your fiance(e) need to completely understand the local procedure including how the consulate schedules interviews....

Immigration attorneys lie. They have to. It is an absolute "must". If they told anyone what they (don't) do, no one would ever hire them. If the attorney was truthful you would laugh and walk away with your money.

NEVER make any plans for travel, weddings, etc. without a visa IN YOUR HAND. To even speculate on a date is foolish. This is one of those points in your life that you do not have control of and all the plans you make will not affect it. And as I have told many people, the NOA2 is the beginning, it is not the end. It is possible that the process after NOA2 could take longer than waiting for the NOA2.
