I had applied for my wife for I-130 by 2007. Detail below:

USCIS received my I-130 at Oct 24, 2007

Notice Date at January 16, 2008

Nothing happen now, I'm going to apply for citizenship by Feb, 2009 this year. If I upgrade my case after I became citizen will my case being faster?

Also when I was filing I-130 I hadn't send any photos with it. Only sent the form, passport photos and marriage approval. Will this take longer on my case because I hadn't send additional photos?

What is the next step should I do? and what will happen to case coming? How this kind of case process? Can any one help please.

After you become a US citizen, you can inform USCIS of your new status and ask to upgrade the application for your wife to an Immediate Relative. After that it should take about a year for her to get here.

It's just taking so long. So after I became Citizen, still need to wait another year, Estimated she will be here by June or July 2010....... I wish NVC can storter their process time.

You will need to call the USCIS to let them know you are now a US citizen, they will then ask you for a copy of your naturalized US citizenship certificate and upgrade your petition. After that, it will take a little less than 12 months for your wife to get her visa.

Don't worry about further evidence since your marriage certificate is more than enough proof of your relationship. If the USCIS feels that they need more evidence, they will send you an RFE and you will then submit it to them.

You will need to call the USCIS to let them know you are now a US citizen, they will then ask you for a copy of your naturalized US citizenship certificate and upgrade your petition. After that, it will take a little less than 12 months for your wife to get her visa.

Don't worry about further evidence since your marriage certificate is more than enough proof of your relationship. If the USCIS feels that they need more evidence, they will send you an RFE and you will then submit it to them.

Thank you, I just called my Attorney, he said I should get approved on my case and get NOV2 already he's going call USCIS for me, but since I was applied and filed in I-130 when I was LPR how long it take to get NOV2 if I mailed by October, 2007 and USCIS got it by January 16, 2008?

When should LPR I-130 get approved?

Good question. For an Immediate Relative category, usually within a year. For others, it could be 6 months to 5 years. I've seen F3 get it in less then 8 months (my brother) while F4 have been waiting for 2+ years (my cousin's brother).

Find the Service Center that has your petition and it should give you an idea when your petition would be processed.

we have the same situation. my husband filled I130 for me since oct. 18, 2005

but they only sent us notice of receipt, and nothings follow.

we decide to filled N400 for his citizenship oct. 2008 and this year of february he passed his interview. and just only

waiting for his oath taking.

the next step we plan is to upgrade his petition for me at USCIS.
