My husband and I filed at the end of November for K-3. After reading everything that's been recently posted, should I file also for the CR-1 so that he can work when he gets here? How does that work if we go that route? We are expecting a baby in June so we did not have time to properly research before filing--just wanted to get started. Any suggestions are greatly appreciated.

If you applied for K3, then I am assuming that you filed a I-130 followed by I-129F. The I-130 is all you need to pursue the CR-1 option and so you have already filed whatever you need for CR-1 as well. Typically both petitions (I-130 and I-129F) are approved at the same time and so you have the option to pursue either type of visa. With the CR-1 it may take a little longer for your spouse to reach the US (although lately the difference has been in terms of weeks rather than months) but he would be able to start working right away and you don't have to go through the adjustment of status process (which you would have to if you go the K3 route).

07/13/09 - NOA1 received for both I-485 and I-765 !

08/08/09 - Biometric appointment

08/25/09 - AOS interview letter notice date

09/24/09 - AOS interview

10/03/09 - Received GC !!

you already filed for the CR1 also, in essence. The CR1 is the 130 petition. Once you guys are approved, you will basically have a choice to either ignore the CR1 correspondence from NVC, and go to the K3 interview scheduled by the consulate. OR you can get everything back to NVC and use the "shortcuts" available somewhere on the site(check NVC forum) and try to get the CR1 packet to the consulate before the K3 interview.

In that case, your husband will interview and hopefully receive a CR1

Yes, the overall expense is that much less from filing to green card. Also he would enter the US authorized to work with the CR1 visa and need to wait about 4 months for work authorization if he enters on the K3 visa.

Have you actually filed an I-130 and an I-129F or just the I-130. Please clarify.

Facts are cheap...knowing how to use them is precious...

It really depends on your priorities, in my opinion.

The CR1 can take a little longer(not much!). But it's benefits are the lesser cost, the ability to work right away, basically upon entry and you dont need to go through the adjustment of status.

If working quickly and convienience outweight the possiblity of a slighty longer seperation, then the CR1 is for you.

Do check the NVC shortcuts, some people have sucess in speeding through NVC, and then there isnt the longer seperation factor :)
