I am about to start the application process for my mother who lives in Nigeria.My brother and I are both citizens but my question is based on who will be best suited financially to file the affidavid of support when the time comes. And does it matter who files for her now?

I am currently in graduate school. As a result,i dont work and my financial support comes through financial aid from the school, equivalent to about 23k per year. And i dont file taxes as a result

My brother on the other hand, an accountant by training but this whole job market/economy made his income from last year about 10k. From his previoius yr was about 24k. but he does file his taxes

So my question is this. who should file for her? my brother or I. we both live in the same household so address is the same.

Either of you can file for her. The person petitioning for her would be the primary on the Affidavit of Support while the other can be the secondary. However, your combine reported income may not be sufficient to support your mom and she may not be able to get an immigration visa. A careful calculation of the expenses from filing the I-130 to airfare to the US, and whether you meet the minimum required income requirement should be made. Perhaps, you should wait until your financial situation is in a better place.
