Hey all,

It's been hard for me to get on here lately and things are begining to get extremely tough for me. My wife is due to give birth of our first baby at the begining of april and I am sweating bullets that she won't be able to come here before then. My biggest fear is that if her visa is not granted prior to the baby's birth, it will only complicate and prolong our reunion together. Will I have to file another I-130 for the baby after it's birth? Will we have to go through this long wait all over again? I've heard from a few sources that the baby can claim dual citizenship, as long as we go the the US Embassy in Manila with the baby's birth certificate and our marriage certificate. However, I am not so sure how accurate this is and if so, how long would it take to obtain the baby's US passport?

We applied for our I-130 back on Aug 11 and our K-3 around 1 week later. I'm already seeing I-130 applicants from sept and oct VSC being approved and although I am very greatful for those families, it's very depressing for me here. I think it sucks that families who filed for the K-3 in conjunction with the I-130 do not have the privilege of getting their cases transfered to VSC! Afterall, didn't we file for the K-3 so that we can "quicken" the process??? If I knew all the things I know now, I would have taken the opportunity to move to Portland, OR when I returned from Asia in August; thus, putting my file at CSC. Furthermore, since I decided to come back to the east coast, I definately would NOT have filed the K-3 in conjunction with the I-130. As a taxpayer, I am appauled at the way our system operates.

I apologize everyone, I know the story has been repeated over and over again here, but now it's my time to vent. I'm just very sad at the way this thing is moving and all I want more than anything in this world is to be with my wife here and to witness the birth of our son. It's going on six months since I last saw my wife, with the holidays and our one year anniversary already passing making it even harder. Not to mention, the winter here in the northeast can't get any colder and depressing than what it already has been!! :(

I think, not to worry. I believe that children below a certain age do not count. Your wife can just bring the baby with her.

I am almost 100% sure of this, but i could be wrong. I would call uscis or nvc to get the real scoop.

Yes it is hard, it is the hardest thing I can think of.

Your situation is not so different than mine. If the baby is born there, YES, you will need to get a passport for the baby, and that can be done in 1-3 months I think.

But, biggest fear for you is timing now. Many airlines wont let a pregnant woman fly if they are within 6-8 weeks of their due dates.

I would send in an expedite request, explain the situation, explain it is for $$, Child's Health, and additional paperwork complications and see if you can get them to rush your NOA2 through - My situation was not exactly same, but similar - I requested the expedite and hopefully my fiancee will be able to be here within 6 weeks now.

9/3/08: Submitted I-129

9/5/08: CSC received

9/8/08: NOA1 date

11/12/08: Requested expedite (promised response by 11/17/08)

11/19/08: Received status info by calling USCIS - Additional info sent

12/4/08: Call from CSC & "Touch"

12/4/08 to 12/22/08: Too many calls & faxes to mention, NO RESPONSE!

12/22/08: NOA2 Approval!

12/30/08: NVC forwarded petition to Embassy in Tokyo

12/31/08: Letter from NVC stating they forwarded petition

1/4/09: Received Letter from NVC

1/7/09: Packet Issued from Tokyo Embassy

4/18/09: Tokyo still unable to grant interview, moved to Philippines.

6/22/09: Our daughter was born (more embassy paperwork)

6/30/09: Reqeusted transfer of case to Manila

8/26/09: Visited embassy in Manila AGAIN, personally requested transfer of case (no record in their system)

11/4/09: Case Transferred from Tokyo to Manila - no notice sent

12/5/09: Notification that Manila received the case.

12/30/09: Interview packet received from Manila

1/25/10: Medical check in Manila (took 4 days)

2/1/10: Interview - requested additional docs,

2/2/10: Additional docs submitted, Embassy kept passports - expect visa soon.

4/5/10: Received Visa FINALLY!

4/12/10: Entry to USA

This kind of speculation is potentially very harmful. Each person counts regardless of age.

If the petitioner is the child's parent, in most cases they file a Consular Report of Birth Abroad and get the child a US Passport. This can add some time to the reunion but probably not more time that giving the child a few weeks to be healthy and strong enough to travel would add anyway.

Facts are cheap...knowing how to use them is precious...

pm me and I will explain what I know about this.It is alot eazier to do this via phone. My son was born there also.We got his CRBA/passport and now he's getting his RP passport. It takes some research and patience but it will all work out.

My son was born in the Philippines only take me a week to get his US passport.

My Daughter was born abroad (Japan), all we did was go the the Embassy to file a Consular Report of Birth Abroad and at the same time filled for our daughters passport. At the time we were not married so we had some extra questions to prove our relationship but that went by with no problem (you wont need to worry about this b/c u are married). Got the US passport about 2-3 weeks later.

I know this is kind-a old post but I did the Consular Report of Birth Abroad in Manila if you need any info just ask! It took me only 2 weeks to get my daughter's US passport and C.R.B.A. Cert.
