Can my fiancee visit me in the US?

I sent my k1 on june 5 and it was received at Vermon on june 7th...........i have not recieved a NOA1....would it be aproblem if my fiancee visits me for 2 weeks.........she's thinking of coming next week.

would she have a problem at the borders? would the k1 show up on the computers? any way to avoid problems?

Is your wife part of the VWP? If she isn't then I believe it would be a definate no for her coming to visit you. If she is, there is still a risk of being sent back without leaving the airport. I believe it would be riskier for a K-1 petitioner due to the fact that it is easier to just get married without waiting for the K-1 once she is in the US then it would be if you were already married and waiting for the K-3. Either way, it is a risk that can go either way. It all comes down to who she gets at customs and what kind of mood they are in. I know being American myself I have been given a hassle coming back into the country.

THis is just my opinion. The only thing I know to be fact is about the Visa Waiver Program. It is a risk you need to weigh out and see if it is important taking it when it could potentially cause problems in the future. Goodluck with whatever you decide.

I can't say there isn't a risk that she'll get denied. There is. BUT if she comes with plenty of evidence to show she'll be returning to Greece after a couple of weeks she has a good chance of getting in IMO.

My fiance came to visit in April (we started the process in Feb) and he brought with him a letter from his employer stating the day he was due back at work and saying he was a full-time employee. He also had his return ticket on hand to show he was planning on going back. He answered all their questions honestly (just here to visit, I am returning home in 10 days) and they let him in.

It all depends on the officer, of course. I know another VJ member here in Michigan who's fiance was denied entry at the Detroit airport.

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

My fiance didn't have a problem getting in, but he brought plenty of evidence that he would be returning to the UK--deed to house, letter to employer, recepit from the kennel where he had his dogs. They didn't ask for any of it, but it's best to be prepared. He was eligible for the visa waiver-- I agree that unless that is an option, you might be better off doing the visiting.

How would they know that you have filed the petition? My fiance doesn't have any stamp in his passport or any way of immigration knowing that we have filed the petition. Is it riskier once it has been approved? I'm just a little confused as to how they would know that the petition has been filed when your fiance goes through immigration. Please let me know!

CBP does know if there is a I-129F in process. The airlines wire their manifest with passport numbers and other data from the passport ID page to the CBP. The names and information on the manifest is crosschecked against a whole slew of databases while you are still in the air. That includes USCIS's database. So when you arrive, there will be a listing of your I-129F on the screen.

Once it is approved, you must enter on the K visa. You are no longer eligible to enter the US as a visitor.

Boy I'm glad I read this thread. Considering the latest delays with I-129F processing I have decided for me and my daughter to visit my fiance in the US while waiting for the petition approval.

I never realised there was any potential problem - I mean, why would someone start the K-1 process if they were going to sneak in illegally.

I'm going to get copies of my annual leave approval, mortgage papers, letter to daughter's teacher requesting 2 weeks of homework, copy of return ticket details.

Any other suggestions? Coming from Australia to LA is long and expensive - I would be so mad if I got rejected. And its so hard to be nice to the immigration officials at the best of times - they're soo mean and grumpy!
