Today we went to the SS office to apply for a number. We were told that there is a conflict regarding my wife's married name and the name which the INS has for her (her maiden name). They also told us that it could take 4 months to reconcile this name difference. So we may have to wait that long before she can get her card.

Here is our process up to this point.

Fiancé comes to US on KI

We marry with 90 days

We apply for AOS, EAD, and AP (in her married name)

We received EAD and AP (both in her married name)

The AOS is in process

Now the SS tells us that we must wait 4 months for them to reconcile her maiden name (which the INS has and her married name (which the social security office has)

The social security office tells us that this frequently happens.

Is this a common occurrence? Could I have avoided this somehow? Is there anything that I can do about it now?

We sort of had the same issue...Our SS office said there is a conflict in her last name, obviously...we are married and showed the marriage certificate while applying, but had to go back there after 8 weeks (Since I called to find out why we hadn't got a SSN yet) and show them the marriage certificate AGAIN (I told them we did this when we applied and their response was that they probably missed this) and a week later we had the SS card in mail

We called our local SS office, not USCIS....The number for your SS office should be listed on the paper which you should have got after applying for your SSN

My fiancee (now wife) arrived on a Thursday, we applied for a SSN on Friday (she didn't change her name) and we received the SSN before we were married. I would think showing the marriage certificate is enough. I think you need to speak to a supervisor there, after all if an American woman gets married and changes her name I have never heard of any problems with the SS office. Clearly the visa and marriage certificate show what happened and it is a typical operation. If it happens "a lot" they should have a standard procedure that even a paid-by-the-pound SS clerk could handle.

i got my ssn before we married then i went back to ssa to change it into my married name and so after showing them marriage cert and passport they gave me a letter stating they have to verify to the USCIS my staus before they can send me the SSN card.

as far as i understand, its because of the I-94 that i have is already expired when i went there for a name change that made them want to verify to the uscis my staus.

(my I-94 was still good - UNEXPIRED when i went there first and got a ssn on my SINGLE name)

it just drives me nutts now because the letter that they gave stated my new name/ married name wrong! the mistake is on the suppose to be my NEW MIDDLE name, it suppose to be the last name when i was still single but what ssa did was they also used my middle name when i was still single as my middle name now that im married! so im waiting for the new ssn in our mail and when i get it, i'll go check to the ssa to correct my NEW MIDDLE NAME.

and yeah it says there that it can take 4-6 weeks to verify

So the suggestion for other K-1 holders...get the SSN immediately (in her maiden name, the same name on the visa) , like within 24 hours after she arrives, and then after marriage apply for a NEW card in the new name (if she changes her name) and then at least you will have an SSN while the SS admiistration gets their act together and re-invesnts the wheel for the 10 millionth time.

Unfortunately you cannot apply within 24 hours after arrival into the country. It can take upto 2 weeks for the data from her I-94 to get entered in the SAVE-ASVI database system which the SS office access to verify the information.

So the suggestion for other K-1 holders...get the SSN immediately (in her maiden name, the same name on the visa) , like within 24 hours after she arrives, and then after marriage apply for a NEW card in the new name (if she changes her name) and then at least you will have an SSN while the SS admiistration gets their act together and re-invesnts the wheel for the 10 millionth time.

Hi everybody,

Just got approved for the K-1. My fiancee plans on changing her last name to mine when we are married. Which of the two options is better based on people's experience?

Option 1:

1) Apply for SSN (maiden name)

2) Marriage

3) Change SSN (to married name)

Sounds like there is a potential pitfall with the second option? However, it also sounds like it's an issue that the SS office doesn't have people in the system until two weeks after his/her arrival. A SS card is pretty necessary to get all of the paperwork things (driver's license, bank accounts, leases, etc.) in order. Anyway, thanks for your help!

For me, its better to get married first and get all papers ready for AOS and once its on file with USCIS get SSN. So no problems of changing names or what ever for more delays. SSN is not really needed if you dont have your EAD yet.

It is bullocks! They should have no problem using your certified marriage certificate to issue her a SSN in her married name. Whoever you talked to was an idiot...

This reminds me of a recent gal who came to our clerk office wanting to file a name change. The brain surgeon at the Social Security Department noted that they, and they alone, had scrambled her middle names. Her Drivers Permit and Birth Certificate matched, but the office record at SS scrambled her middle names. His/her solution was to send her off for a name change to match their records. Idiotic!

By applying for the SSN after getting married, and thus the name change, you have made it easier on yourself, and the Social Security Department, unless of course you get an idiot behind the counter as apparently you have. Good luck! Go back and ask to speak to someone else.

I couldn't agree more with the previous poster....I sometimes wonder about the people that work behind the counter..Example: Went to apply for SSN after marriage and lady looked at the K-1 visa and told me that since we are now married, she needs to apply for a new visa :bonk: I said "Oh ok, thanks" and walked out of there, drove 40 mts to another SS office and applied with no problem.

unless of course you get an idiot behind the counter as apparently you have. Good luck! Go back and ask to speak to someone else.

i just received a letter from the ssa saying they cant issue a ss card to me yet (with my married name) due to an about to expired status in the immigration ( im absolutely assuming theyre talking about the I-94 deadline) and theyre asking for a new I.D. "work permit" or a green card.

oh well, i knew it! we just sent our aos so im wating for ead and im gona get back to ssa and dmv SOON!
