My fiance had an interview at the Albanian Embassy on January 15, 2009 and he was approved!!!!

I am so happy and I just wanted to share my experience in trying to obtain a K-1 visa. (P.S. - I've screwed up my timeline and am sorting it out with the moderator, so don't check it...). I filed in April 2008. USCIS approved the petition in August 2008. We had a few stumbling blocks along the way, but my fiance's interview was scheduled for January 15, 2009. (This was outside of the 4 month validity period of the NOA2, but I had already emailed the Embassy prior to the expiration date and they said not to worry, that the petition could be extended.)

I was really fortunate to be able to be in Albania with my fiance at the time - which I found out later was necessary in our case:

A little background info - I graduated college in 2007 and did not make enough money. I have been working in 2008 and made enough to cover the requirement, but this meant that I was unable to produce any tax returns, as most people file in March/April. Also, I was unable to find a co-sponsor. However, I filled out the I-134 with my anticipated 2008 income and wrote a letter as to why I did not have any 2007 tax return. I mailed these letters to the Embassy along with everything else required by the Embassy. I pushed my boss to send me my 1099 form at the beginning of 2009 and was able to supply this on the day of my fiance's interview. I knew this was cutting it really close, but I hoped that everything would be sufficient.

On the day of the interview, I was so anxious - my fiance went into the Embassy at 1pm and I was able to enter at 2pm (Embassy rules for U.S. citizens). Thankfully he hadn't been called in yet, so I sat with him in the waiting area. Finally his name was called and he went into the office - a few minutes later he stepped outside and called me to come in and I spoke to a receptionist (?) who was in the midst of putting his file together for the Consular Officer. She said I had everything, but asked me if I had a 1040 form, which I guess is the tax return form (?) and I said no, but I showed her my 1099 which showed my earned income for 2008. I emphasized that I hadn't filed my taxes yet, but that this was my proof that I had made enough income. I don't know if I was getting hostile and maybe I was just really nervous because I knew that I couldn't provide those things, but she said, "It's okay, let's not argue about it, the Consular Office will explain everything to your fiance during his interview." And then I had to go back out into the waiting room.

Soon after, my fiance came out and sat with me. Ten minutes later he was called back in for the interview. I sat outside ready to cry/vomit because I wasn't sure what would happen. Anyway, after five minutes my fiance appeared at the door again and motioned me to come inside. I went inside and we stood in front of a window with the Consular Officer behind it. He was very pleasant and asked me about the tax situation, which I explained. He said he needed a written statement regarding everything I said verbally and I showed him a copy of the letter I had sent, which he later found in his file. Ultimately he agreed with me and then proceeded to ask ME a few interview-type questions with my fiance still there. He asked me where we met, where we plan to get married, and when we plan to get married. I thought that was really strange and something I hadn't read about on this website, but oh well. Finally he said "Everything looks to be in order - you're not planning to travel this weekend are you? [Me: No.] Then you can come back on Wednesday for the visa" and he gave my fiance a blue slip and started speaking in Albanian to him!!!!!!!

OH MY GOD, I was so happy I was partially crying and kissing my fiance. Whereas 10 minutes before I thought I would be vomiting on the floor, I was now so relieved and thrilled. After 3 years long-distance and 9 months of this ordeal, he's finally going to be able to come to America! 06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
