Visa/Annulment Rip Off

And remember it's 99% of the lawyers that give the other 1% a bad name.

Ha, that 1% had to be in my county, learned that lesson the hard way when my ex decided to divorce me. And why not, was severely injured in an auto accident, so she didn't think I could no longer support her extravagant life style. Very next day, hires a man hating attorney. I didn't want to hire an attorney, but ex's attorney told such outrageous lies, had no choice. And the judge appointed more guardian type attorneys for me kids, even though the testified they wanted to stay with me. Learned later, the judge could not do this without my permission, he did it anyway. And those bills from the guardians were outrageous claiming they were in meeting with my kids when they were in school.

I reported the entire flock to the WI state bar, only to get a letter back on each attorney that the bar does not deal with billing issues it was up to me to sign a very well spelled out contract. Ha, have to hire yet another attorney to verify that contract, and maybe another one to check out the second attorney. Also learned that judge came from a law firm where most of these attorneys were appointed from, so reported him as well. The only satisfaction I received was each of them had to send a very long letter explaining what they did, and my complaint would be on their records. But I had to pay all these bastards.

If a lesson was to be learned, really do your research when hiring an attorney, and check his background, did that for other matters in my divorce that had to be cleaned up and especially for my immigration attorney all based on a flat fee and what they were expected to do for that fee. That worked out nice.

Why do attorneys have such a bad reputation :blink:

IMO and speaking of the american legal system, one of the big reasons is that in most cases at least half of the litigants leave the process being very very disappointed due to the fact that it is an adversarial system and one side wins and one side loses. Everyone beleives thier side of the argument is right and they dont accept losing gracefully..

There really is no other business that could survive where it is built in that one half of the customers are going be unhappy with the result. A resturant would not last long if half of the people eating there get food poisening.

Another reason is that lawyers often represent people who are criminals and have done very bad things. They represent big insurace companies and businesses that have taken advantage of the little guy. Because they represent possibly undesirable individuals or institutions they pick up the stain of associating with them.

TV and movies have given the public an unrealistic view of what lawyers actually do. In tv and movies the good guy always win but it is not this way in real life.

Finally there is really no such thing as justice. Lawyering comes down to following strict and in some cases arbritrary rules and procedures that produce winners and losers not the best or most just result. Courts and government agancies are usually understaffed and overwhealmed by the sheer volume of work. They are underfunded in most cases and the emphasis is getting the case through the system not finding a "just" result.

There are many more reasons but in my opinion thses are some of them.

I typed a response to a thread about attorneys that was here a short time ago, but the thread was removed by the time I finished typing it. Here it is anyway:

The old 'to hire a lawyer' debate...

I hired an immigration attorney, and while his services weren't cheap, I have no regrets whatsoever.

There weren't any serious snags in our case, but there were some. When there were, I had someone who knows the system there to fix those snags, snags that were caused by mistakes and basic incompetency on behalf of the government.

My attorney was also an insurance policy of sorts against the off chance that immigration officials would have a serious problem about any aspect of our case and deny us outright. That didn't happen, but my attorney was there in case it did. I'm not sure what he'd be able to do if we were denied, but whatever he'd do would certainly be much more than I'd be able to do myself.

I read a lot of threads here where posters seek advice concerning a delay caused by a document that was filled out wrong, incomplete, or missing altogether. That didn't happen for me, because I had an attorney to make sure everything was right the first time.

A friend recently got a cat from a lady whose house cat had given birth to a litter of kittens. The lady had put a 'free kittens' sign out front and my friend saw it and went in and got a kitten. He had been trying to adopt one from an animal shelter, but he gave up because the animal shelter had a list a list of prerequisites a mile long. He'd have met all the requirements, but it was just too much of a headache to deal with, especially when other people were out there putting 'free kittens' signs out front.

We don't have that option with our spouses and fiances. We have to prove that we meet all the requirements. Husbands and wives aren't cats either. Cats are nice to have around, and though you love them, they die after a few years and you replace them. I'm sure there are specialized lawyers who will help you adopt a cat, but it probably isn't worth it. Husbands and wives are human partners for life. I'll take all available measures that help insure that union. Thus, I hired an immigration attorney.

When my wife's conditional Green Card is up for review in two years, I'll be using the services of the attorney who helped to get her here in the first place.

Make sure they are good and check out credientials and ratings. most lawyers dont take time to do what we the sponsers all do, or they have thier para legals do foot work. I had no lawyer and was advised to get one multiple times , by my local lawyer0 and we came through allright. I doing the research and all the documents, hubby even had a brush with the law ( while on conditional whew) here and we did allright on our own with our local lawyer. Being through honest, dont over load them with too much information . etc.. senator backing letters all helped. Ive seen lawyers hang out here to find out what to do . now that is just wrong. advice from us LOL. If you have money then go on, myself i would end up double checking thier work, like I do the Drs when my family in hospital. So many mistakes can happen when strangers are invovled in your business. On the other hand they might be able to catch something you ahve missed as well. Im glad you have dried up and looking better for your new wife uncle wally keep up the good works man. Peace

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

I'm adding this thread to advise anyone that is or has used an attorney to obtain a visa and/or annulment and has been defrauded, lied to, or represented in anything but a professional manner there is a remedy in law that will provide justice and very likely will enable you to obtain a refund of funds. It's a very simple process and takes little time to accomplish. You simply contact the Bar Association of the state the attorney is licensed in, request a formal complaint (most cases can be done right over the internet), fill in the blanks and return to the Bar Association. That simple. Don't take abuse laying down!

I would venture to say almost all people using an attorney have been lied to, at a minimum. Did they ever say to you the USCIS tries to find reasons to reject these cases? LIE. Did they ever say they could get it done faster or even imply they could by showing the "official timelines" and comparing it to their cases? LIE.

The FACT is an attorney can ONLY cost you money and ONLY slow the process compared to what you could do yourself. Unless you have some unusual circumstances, you have no need for an attorney and even then I doubt you need one. Basically, if you meet the qualifications you WILL get your K-1 visa, if you do not or are somehow disqualified, an attorney cannot get you "qualified". He can, however, consume large sums of your money in the effort.
