My finance got K-1 to come in the states on 11/30/08 and we got married on 12/5/08. She tried to get a driver's license in CA (pain in the ####) and passed the written test on 1/16/09 and since her I-94 expired on 2/28/09, the written test / temp permit will expired on 2/28/09 as well.

My question is that :

1. can she take a behind the wheel test before 2/28/09 and get a paper permit to drive?

2. or should she wait for EAD then take driving test?

3. what is the fastest way to get a license?

4. how long will it take to get EAD after applying I-485, adjust status?

Until she gets some sort of documentation from the USCIS everything would expire with the I-94. It took us about 2 1/2 months to get Claudeth's EAD.

I have the same case here. Both in CA. If that's the case, she should take behind the wheels already. At least she has 1 month privilege to drive if she passed. Because the time I-94 expires, driver license also expires. You have to wait for approval notice of AOS or the EAD to renew the license. That's how it is here in CA. :whistle:

2-3 months to get EAD.

1. CA will set the permit's expiration to the date on the I-94 (This has to do with legal presence).

2. Wait for EAD

3. Need EAD. (K-1 MUST NOT file for EAD before adjustment of status, EAD based on K-1 expires the same date as I-94, and costs $340, typically it expires BEFORE USCIS can approve and issue this EAD)

4. (90 days)

Moving this to Work/Travel before green-card forum, because EAD is an interim benefit for before green-card issuance.

One note, my Yu came from mainland China, and has had a learner's permit for over a year, has taken the road test 2 times so far. Keep in mind if your spouse has never driven before, it may take some time to get a license in any case.

Will she need to take another written test after she gets EAD?

If we decide to go for the Driving test before 2/28/09, will DMV allow her to take the test when her I-94 will expired in less than 40 days?

This is up to the DMV, every state is different, driving privileges are granted by the state that you live in.

I am tired of DMV these losers refused to issue a Stated ID or DL untill I get my GC, its really frustrating, bad customer service and rude to customers :crying: :crying:

I am in NY. My wife took the wriiten test and passed. Her permit expires in i believe 4 years but it is stated that her status expires 5/23/09 which is when EAC expires. Can she take the test after that date? or if she takes the test and passes can she continue driving although it states that her status has expired. i would believe that the license is still valid. which is it?
