MY wife's greeen card expires in June of this year (her two year card) and we need to apply for her ten year card. Her son who is 17 is also here and he needs to apply for his first green card. Can I do both together? My stepson just had his physical, does my wife need to have another medical exam? Will she need to go get fingerprinted and photographed again? Is there a fee for the I-751?

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

You file the 2 cases separately, Son's AOS will be processed by NBC, your wife's removal of conditions is handled by VSC or CSC.

NO medical needed for removal of conditions (I-751), she will do biometrics again (Fingerprints, photo, signature)

Son = Form I-485 $1,010 ($930 application fee + $80 biometrics fee)

Wife = Form I-751 $545 ($465 application fee + $80 biometrics)

I am confused...I was told by another person that my step son does not need the I-485 since he is under 18, he can have his status adjusted at the same time as my wife's is done? I apologize if I am asking stupid questions but I can not get a handle on the laws, too complicated for me to fully understand.

First and foremost, each intended permanent resident needs there own application... no riding mommy or daddy's coat tails here like they do on the "K"....

Second, even if it was, they are NOT adjusting status together as your son is adjusting status (I-485) and your wife is removing conditions (I-751). If the two were in fact removing conditions together (only if the greencards were issued within 90 days of each other) it could be a possibility but in your situatio it is not......

May be a good idea if you get a lawyer.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
