SOUTHOLD, N.Y. – Police on Long Island arrested a man after he allegedly kicked a police car and asked to be deported back to his home country of Guatemala. Police said the 27-year-old man called the Southold Police Department early Sunday and asked to be arrested so he could be deported.

Police said that when officers arrived at the scene, they told him he could not be arrested because he had not committed a crime.

That's when, according to police, the man kicked the driver's side door of their patrol car. The man was arrested and charged with fourth-degree criminal mischief.

Details of his arraignment were not immediately available.

Kicking a car is criminal??

vandalism. what's amusing is the police didn't think him being in the country illegally was a crime.

Strange usa ............. that man shd have been taken to a govt councel of some kind to investigate why he is in that mental state and if he is legal here and ispite why is wanting to be deported. To me police instigated the man to commit the crime ( or whatever ) ,..... i dnt know when wd USA become a human being from Robot. :jest:

Deportation is a lengthy ordeal...

A friend of mine was in a car wreck cause by an illegal. The police came and asked for the man's identification and of course he didnt have any. He was cited and given a court date but no arrest was made.

I dont think local police attempt to take on more work and headache. maybe a jurisdicional thing

It does not say anywhere in the article that the man is here illegally...he could be here illegally, we don't know.

Over here in Aruba illegal immigration in itself is not considered a crime. Therefore, the police cannot arrest someone for being an illegal. However, they can be temporarily detained and must report on a certain day to the Immigration Department so they can be send back to their country of origin. Flawed system to say the least btw...

Anyway, the only way they can be detained for immediate deportation is if they get caught trying to enter the country illegally.

I don't know if this is the same in the USA. Maybe the police don’t have the authority to arrest an illegal immigrant; I believe that authority lies with the INS.

It would be pretty dodgy to be arrested if you were on an overseas vacation and overstayed your visa/waiver by a few days. Local police would have to deal with calls from irate consulate officials.
