Hey guys,

Okay, so I applied for a K-1 with an ex in December 2006. In May 2007 he was approved for his K-1 visa in London, UK. We broke up in June 2007 and NEVER used his K-1. I called the American embassy and they said that there was no need to cancel his visa as long as he never used it. He never used it.

Now, I'm wanting to apply for another K-1 visa. I will hopefully be beginning the process next month. My question is: do I need to write an IMBRA visa waiver letter? I'm a bit confused really! I know that under IMBRA you cannot apply for more than 2 petitions..but I also thought that there was some rule about applying for your second petition within like 3 years of the first, or something!?

If someone could clarify this for me that would be greatly appreciated! Alternatively, perhaps it is not required that I write a waiver, but maybe it would be a good idea anyway? To try to get ahead of an RFE?

I agree. Just write a request and explain briefly the circumstances.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.
