Timeline

I just got my W2 today from work. I am also ready to send my fiance the i-134 and want to know if i can just make a copy of my W2 and send it to her because it shows i make sufficient funds to support her or do i have to get it filled and show a tax return from my accountant? Please let me know because i would love to send her the I=134 to her tomorrow.

Since you haven't filed your 2008 taxes yet and the deadline to file is not until 4/15, you can send her a copy of the 2008 W2 as well as copies of the W2 and tax returns for 2007. If you don't have them, you can get transcripts from the IRS. Also, make sure you have copies of your most recent pay stubs and letter of your employer for more proof.

What if my 2007 tax return does not show i make sufficient funds to support her but my 2008 W2 does show i make sufficient amount of funds, then should i just mail her a copy of my 2008 W2?

My understanding is that you only need your tax returns if yo are self employed.

w-2 + pay stubs + employer letter should cover you.

You can send your tax return for 2007 if it is the last year you have completed at this time. You can also send a copy of the 2008 w-2 as further proof of your income. When is your interview date? If it is soon, then use 2007 tax return with the addition of the 2008 w-2. If it will be some time before your interview, then wait to fill out the I-134

Literal reading of the instructions would indicate you only need a tax return if you are self employed, true. In practical terms it is expected with every I-134, I didn't care to argue the point 6500 miles from home.

I have a appointment with a CPA on Thurs to file my 2008 taxes. I will then mail it to my fiance in Japan. I figure this will make everything easier and we don't have a interview date yet so i figure i still have some time. We are still waiting for her police records from Austrailia which will take a lifetime to recieve.
