Going out of USA on a pending case of removal

I really need to leave the country for a few months in Canada(Family issues)...My case for removing conditions is still pending. Will this cause any problems? Thanks in advance.

just got back from my country after a month with expired green card and NOA.. No problem

As long as you have received your NOA, which extends your GC for one year, you will have no problems returning to the U.S.

Just make sure you have both the NOA and your expired GC.

Yes, I do have my expired card and my NOA...I've used them a couple of times already with no problems! But I'm concerned more at this time because it will be a longer period of time ...3-4 months.

As long as you don't stay outside of the country more than 6 months or beyond the validity of your extension period, you should be ok. Good luck with the family situation.

as long as you don't stay too long (more than 6 months), maybe get a re-entry permit just in case you need to stay longer. The only problem you could have is if they ask for more evidence or ask for an interview and you are away. Otherwise you will be ok.

Mailed N-400 March 6th via priority certified mail and Rec'd 9th (confirmation by USPS)

NOA rec'd: 3/19/2009 (date 3/16/2009, priority 3/9/2009)

Biometrics rec'd 3/26/2009, appt 4/9/2009

IL: 5/22/09

ID: 07/06/2009

Oath: 07/16/2009

SSN updated: 7/16/2009 (not received yet)

Passport rec'd: 8/15/2009(nat. certif not rec'd yet)

If case is pending, and you got your NOA, you may go out of the country - not more than 6 months.

If case is approved (10 yr card), and plan on staying out of the country for more than 12 months - u request a re-entry permit.

In your case, 3-4 months - you will be fine. If still worried, call the USCIS and talk to an officer. Sometimes it helps relieve 'back of the head' doubts if you actually talk to them :) Good luck

Well, with expired card and NOA, you shouldn't have problem at port of entry in USA as officer should know abt this...

My question/concern is that what happens when you try to board from your country(in my case its India) and also the transit country(i.e Germany to change filght) as they may not be familr with this and what if they make big deal abt expired card and dont understand the NOA letter ??

Any experience/feedback ??

You should be ok but I wouldn't go for more than 6 months :unsure:
