Because you are filing your tax return as an attachment to your ITIN application, you should not mail your return to the address listed in the Form 1040, 1040A or 1040EZ instructions. Instead, send your return, Form W-7 and proof of identity documents to:

Where can I get help with my ITIN application?

You may call the IRS toll-free at 1-800-829-1040 for information and help in completing your Form W-7 and your tax return, or to check on the status of your application six weeks after submitting Form W-7.

Assistance is also available by appointment at IRS Taxpayer Assistance Centers (TACs) in the United States to provide in-person help with ITIN applications on a walk-in or appointment basis. Applicants outside the United States may contact an overseas IRS office to find out if that office accepts Form W-7 applications.

You may also use the services of an IRS-authorized Acceptance Agent.

When you send your 1040 attach W7 with that. I am going to do it this way and I have to get my wife's copy of passport notarized.

just question, how you are going to get the pasport copt notarized if you wife in not in the US?

I just came back from the IRS office, I had my W7 , the sworn statement and a photocopy for my wife's passport plus my complete 1040 form. the lady said they need to see her actual passport. even a notarized copy is not acceptable. she said if I have the Notarized copy of her pasport I only can send the forms by mail. but, even if I get a certified copy of her passport and I mailed all these form, what would be left for me to sent it to NVC? I was hoping to get a copy for my submitted 1040 to send it to NVC.

I dont know what to do!! I was hoping that I can file Married filing jointly and get a 1040 copy to send it to NVC. I have everything ready but my 2008 taxes. Please let me know what should I do to get this done with.

The bad thing about filing with ITIN is that, your spouse is not eligible to get anything on the stimulus package. Only filing with SSN will be eligible and you cannot do any amendment by changing from ITIN to SSN.

My wife is still waiting for consulate interview. As of today, the case has been completed at NVC. So, I expect around 8 weeks to get Package 3, plus another month for consulate interview. I plan to file an extension, rather than going to the ITIN route. I believe that my wife can be in the States before October, 2009. By that time, we should be able to obtain the SSN. Filing with SSN has a lot of benefits. That stimulus package prompts me to think twice on this one. If President Obama decides to do another package next year, ITIN will not be eligible.

However, if your spouse does not want to come to the States and decides to stay in the home country, ITIN is the way to go.

This is just my two-cent opinion. Thanks.

I've sent your question to my tax experts and am waiting for a response.

I don't think the IRS would accept an extension due to waiting for a SSN since the ITIN is available.

Your situation is different than mine. The IRS extension is valid up to the 15th of October. If you are waiting, you will be jeopardizing your late filing and perhaps you will be misfiled. I am uncertain when your wife will be over here. You are risking yourself on the site.

If you are in the process of interviewing within two months, it might be worth filing an extension. If I am in your situation, my answer will be -> I will file for the ITIN. When you wife arrives, she might get the SSN next year. I do not think you can amend the tax with the SSN on the same tax year.

Again, I believe that it is a timing. (I will also keep all of the tax evidents. My wife works abroad and has already paid her income tax. By filing the return here, you need to know whether there is any chance to get be taxed twice or being in the double taxation situation. Her country has the tax treaties with the USA.)

In your situation, you should file for the ITIN. It is the timing issue. Another thing is, your wife will be considered as a non-resident alien anyway for this year. It does not make any senses to wait.

Well maybe after you fail the resident alien tests, but a spouse of a USC has the ability to file as a resident alien by special election. This will enable a joint return if the taxpayer so chooses

Also you can go to the IRS website IRS.GOV and refer to Head of Household and Publication 501

I am filing joint taxes and yes you will need a W7 which he has to sign also send him the tax return so he sign it as well, then when you have everything send it to the address on W-7 form there is a special center to process those returns you will then get your number within a month or so. Good Luck You will need a notarized copy of his passport

You can only file head of household if you have children; spouses don't count as a dependent.

Here's one for you. My wife and I were married in the U.S. in 2008. So, we have to file as married. However, she lived in the U.S. for almost two years, she already has a SSN, but her income was never taxed while she was in the U.S. She did work as an Au Pair, which for some reason their income is not taxed by the government. (probably because of the little money that they actually get paid, its like slave labor, but thats another story). So, if I file jointly, she does have a SSN, but we are still in the immigration process. Will they expect an income tax return from her as well?

No, if you file jointly she wouldn't file a separate return.
