I have two kids that just entered the country with K2 Visa's, the I-765 form doesn't say anything about a age limit. But I'm curious if there is, I'd like to be able to claim them on my taxes and they require social security numbers... and I'm sure they'll need it somewhere down the line. Please let me know what you guys think... thank you very much

How old are they?

AOS

Date Filed: 2008-08-27

NOA Date: 2008-09-02

Bio. Appt.: 2008-09-18

AOS Transfer: 2008-09-22 to CSC; 2008-11-25 to local office

Approval/Denial Date: 2009-02-10 card production ordered

Greencard Received: 2009-02-20

Removal of Conditions

Date mailed: 2010-11-12

NOA Date: 2010-11-15

Approved: 2011-04-28 card production ordered

Yes, in order to get SSN's they will need EAD or GC... No age restriction for the I-765.

ITIN for each child is a possible interim step before SSN.

If they just entered the country, you CAN'T claim them anyway this year. You can claim them if they lived WITH YOU for at least 6 months in 2008. If not, they can be claimed on 2009 return.
