Error on last name in Birth Certificate

So I need some advice on how to proceed with an error on my fiances birth certificate. Her birth cert lists her last name as that of her mothers maiden name (she was late registered). All her other documents such as local registry, baptismal, school ID, postal ID, etc... list her fathers last name as her last name and we also filed everything such as the I-129 with her fathers last name. We are processing the name change with the NSO but the going is rather slow and it seems it will take many months still. Would it be possible to obtain the passport, cenomar, and copy of birth cert with her moms last name for the interview? I assume this will cause issues at the interview, but otherwise I will have to delay her interview as she is scheduled to interview in February. Also any recomendations to speed up the change of her last name?

All she has to do is go to a public lawyer and have an affidavit to support the error of her name in her BC . I was late registered too and had the same problem but i was approved. Forgot about what affidavit it is but says something like this person named Maria is the same person as Juana in the birth certificate.If she tells the lawyer what the problem is the lawyer knows what kind of affidavit she needs. OK so once she gets the affidavit will she still get the passport and cenomar with the wrong name that is on the BC or will the affidavit allow her to get a passport with the correct name that has yet to be fixed on the BC?

I am not really sure about that nowadays but i got my passport in 2004 and had my K1 process in 2006 and never had a problem with the immigration or embassy. There is no harm in trying ..explain to her lawyer the situation and it will be stated specifically on the affidavit. Yes i was asked the affidavit when i get my passport.She don;t have to change her name in her BC coz it will take years for a public hearing ,,this is what the affidavit is for..to support the mistake in her BC.

Two heads is better than one. Wait for other poster's opinion. Mine was based on my own experience.

Also I forgot .my first passport was in 1995. i was born in 73 and was registered late in 1983.

My fiancee changed her name in 45 days without a lawyer. She was Rosalie in school, college, everything, but on her BC, she was Maruja. She changed it from Maruja to Rosalie. For her interview, she obtained CENOMAR, Police Clearance and NBI in both names. She was approved 11/25/2008 without any delays.

Whatever you do, do it right. Identification, who someone is, who they represent themselves to be is very much a concern to the US Government especially these days and especially concerning a person who resides in a country where corruption is rampant.
