Hello everyone.

I am just about to start putting together the Initial I-129F application.. and reading it i have noticed that it is asking for the divorce date.

Well in My case, My Fiance just filed for a divorce that should end March 3rd. Can i still file the I129F without knowing the real divorce date?. Looking at the time line the dates should overlap.

I want to thank everyone for the enormous amount of information on this site.

I am just about to start putting together the Initial I-129F application.. and reading it i have noticed that it is asking for the divorce date.

Well in My case, My Fiance just filed for a divorce that should end March 3rd. Can i still file the I129F without knowing the real divorce date?. Looking at the time line the dates should overlap.

I want to thank everyone for the enormous amount of information on this site.

That date is going to be one of the key elements to your petition.

One of the minimum requirements is being free to marry - so that divorce date will be looked at and it must be on/after the day you submit the petition (divorce record/decree will be needed to prove this). :thumbs:

My fiance and I waited to file our I-129F until after his divorce was finalized. This way I was able to submit the final divorce degree and its translation with the application. I agree that you should wait until the divorce is finalized before submitting your I-129F.

Received NOA1 -- 11/5/08

NOA2 (email) -- 1/12/09

You must also submit a translated copy of the divorce along with the petition.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

One of the requirements is that both of you must be free to marry. Obviously your fiancee is not free. You cant even submit the petition. They will keep your money and deny it.

You must also submit a translated copy of the divorce along with the petition.

All godd answers. In ase you think you will save time by filing now and answering and RFE later...no, sorry. Since the ability to marry and the divorce decree are basic requirements, your petition wouldbe rejected and denied, then you wouldhave to start all over again.

Better to use this time to collect all the information you will need for the interview and, later AOS. This way you will be ready when the next step comes along.

Can't do it I'm afraid. You have to know the divorce date and the divorce has to be FINAL before you even think about sending that I-129F packet in. You can file is as soon as her divorce is finalized though :)

Agree with the other replies, the divorce date must be finalized. When we did our 129F, I had a certified copy of the divorce and it was finalized. It's best to fill out this form properly the first time so there is NO delays. Having a well completed 129F at the start will mean a quick approval so make sure you have all documents in order. :blink:
