Affidavit from third party

Dear All,

Finally hubby and I decided to use CR-1 and we're still collecting all documents to submit with I-130. I have a question about affidavit from third party, does the third party need to sign that in front of notary public? Thanks in advance.

Yes anyone giving you a affidavit will need to sign it infront of a Notary and prove their identity.

Yes, but why not skip the affidavit and provide evindence in the last "should include one or more..." category instead, like pictures and evidence of ongoing communication? Affidavits are really only a kind of silly last resort, not necessary at all.

Thanks guys for your responses.. We'll submit some pictures of us with my and his family too. We plan to submit affidavit to provide more evidences. If I am still here in the US with my hubby, what kind of ongoing communication evidence that I have to submit? Is it necessary to submit our pictures with family before we got married? Thanks.

try to submit everything that you can from affidavits from third parties to pictures. We had 3 RFEs for our I-130 requesting more evidence. But now everything is all good and my husband is here in the US.

We sent in an affadavit from my mother-in-law and it was never notarized. Our I-130 was approved as well!

We sent 4 notarized. Maybe affivadits aren't required but certainly can't hurt. I wouldn't bother sending them if they aren't notarized - they have no way of knowing that you didn't write them yourself.

We plan to submit, wedding pictures, pictures with families, joint bank account statement, affidavit letters from third party, car insurance policy. That's what i can think for now. Do I need to submit holiday cards addressed to me and hubby? But, there's a problem, at that time we were not legally married yet.. Will it cause a problem in a future? Or Shouldn't I send those holiday cards? Thanks.

When in doubt, read the instructions.

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);

I didn't notarize mine which were handwritten by three different people and affirmed by three other people who were present at the time, it says they have to be affirmed by a third party with their ID#, name, date and place of birth, address and phone. The instructions never said one thing about them being notarized. My petition was approved in 101 days.

Also I think they can tell if they are in the same handwriting as the petitioner. Pretty much it's like making a sworn statement, they have to say I swear and attest to firsthand knowledge of the following info which pertains to knowing you are married.

I had three people make sworn statements, his brother, saying how our families spent time together, my mother, with her knowledge of us always chatting on cam and voice and her own conversations with him. And one from our landlord for three months in Jordan, who wouldn't rent the flat without our marriage cert. and saw us always coming and going together.

We did not submit an affidavit....But still got approval....Might take one or two at the time of interview

The affidavit needs only one signature. The affiant (someone who signs an affidavit) is affirming the contents of the affidavit. The affidavits are intended to affirm what the affiant knows about the bona fides of your relationship, not simply to affirm they attended a wedding. Marriage certificates take care of proving you got married. An affidavit would potentially be helpful if it spoke of what the affiant personally observed about the evolution of your relationship over time. Affidavits from people who know no more about the relationship than they attended a wedding are a waste of time.
