I received our NOA1 in the mail. When I checked my online banking my teenage son had used my atm card and withdrawn cash without asking. This caused my check for $455.00 to be returned unpaid by my bank. WHAT HAPPENS NOW? and will this DESTROY my case? will it prolong it for months? I'm sure I'll get a letter from USCIS but when? It's already been 10 days. This MUST have happened to others at some point. Please someone tell me what to expect.

USCIS will return the packet once they realize the check bounced, you will just have to resubmit it once returned with a new check.

But what does that mean about my case? Does that mean they won't give it a chance now? I need someone to please TELL ME....... PLEASE

Isn't there SOMEONE else out there that this has happened to -- that can give me some hope? I've already received the NOA1

but I KNOW the check was returned unpaid--my bank says so--it's been a little over a week and I've not heard ANYTHING

This exact same thing happened to me when I filed first, only my debit card was stolen. Uscis should send you a notice giving you 10 to 14 days to replace the check and if you pay it within the allotted time you will not need to refile, but since you haven't received anything from them you need to call them asap or you most definately WILL have to refile. They will accept a debit card over the phone as well, at least that's what they told me when I called. This was awhile ago for me though so things may have changed........hope this helps.

I made a mistake in the amount of the check we sent. The application package came back, and I resubmitted with the correct amount. It was processed promptly without incident.

Your physical check may not have yet arrived at your bank -- the refusal to accept it was an electronic message sent to the USCIS's bank. I assume in cases like this, the USCIS will levy a fee just like a merchant would. That, and the time it will take USCIS to process this whole banking thingy will keep you worrying for awhile. But it will not even be a flyspeck on your application once it gets processed. We all make mistakes. Only you can decide whether your son's ATM access to your checking account is wise...

It won't have an impact unless this is a reoccurring issue then they may require a money order

I've tried calling USCIS- I gave them the receipt number on my NOA1 I explained the situation. The only thing the guy kept saying was that their records show I have paid and that they've got the money. I know this is NOT true because my online bank statement says that is was returned unpaid. I can't get a voice to talk to at USCIS. It will be two weeks this week since I have received my NOA1. I don't know what to do or who to contact or how. I want to make sure I clear up this payment immediately including any fees so that this won't affect my case! DOES ANYONE HAVE ANY IDEAS?

Calling USCIS is a waste of time. Just wait until they notify you by mail. I don't think there's much you can do until then.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

HOW DO I GET A HOLD OF THE PERSON IN CHARGE OF FINANCE AT USCIS? HOW DO I FIX THIS? THERE MUST BE A WAY!

The most likely outcome is they'll hit your bank account a second time. Watch for that. It often takes a few days before the payee even knows the payor's check was returned unpaid. They may never know, as their bank may simply put the transaction through a second time.

Facts are cheap...knowing how to use them is precious...
