Im confused as to the 3 year rule. My husband entered the US as a 2 year green card holder then we lifted conditions last year when he received his 10 year. Is the 3 years dated back to his 2 year green card or 10 year? He has been in the country since March 2006. We are trying to find out whether we are eligible or not.

3 years from the date he became a legal resident... the type of greencard (2 yr or 10 yr) is not relevant..

Thank you. Therefore we can apply anytime we will hit 3 years on march 26th so, were in the 90 day window already ! We will probably wait for tax return to come. Dont really have 675$ laying around right now lol
