Help,

My husband applied for employment authorization in March 2006. But we didn't realize we had to schedule an appointment with a service center to get photographs and fingerprints. We were waiting for the USCIS to send us a notice to schedule an appointment.

So, we just made an appointment in June. Does anyone know how long the USCIS would wait for us to make this appointment before denying our application. Doesn't seem that they've denied it yet...but how long before they will.

Can anyone give me a clear explanation of the 1-765 e-file process. I'm lost and making lots of time costing mistakes.

I wish someone would have just told me we were missing something. We've been calling USCIS on a weekly basis trying to find out what is wrong and no one is ever able to provide information.

- 1/05 While applying to grad school, fiance and I do research and gather from friends' experiences that it should only take 3 months to a k-1 visa. Summer wedding here we come!

- Early 2/05, fiance mails his signed copy of the 325 to me (don't know if this step was necessary)

- Late 2/05, Signed 325 lost in mail. Fiance resends signed 325

- 3/4/05, 325 and 129 packet sent to Vermont Center

- 4/3/05, packet returned...I put the wrong amount on the check

- 4/4/05, packet resent

- 4/8/05, USIC sends notice of receipt/action (my mother begins suggesting names for her grandchildren)

- 5/06, Received Notice of Approval dated 5/03

- 5/12, Received notice that petition would be sent in 1 week to embassy in Dakar

-6/3, No longer trust postal system, I send complete Affidavit of Support package with co-worker traveling to Dakar

-6/8, Fiance receives his packet 3 instructions and forms Yeah!!!

-6/9, Fiance called new embassy visa hotline and got interview date for Sept. 12

-6/12, Visa approved and picked up on 6/14

For the EAD, you don't have to apply for an appointment for fingerprinting -- the MSC will make the appointment for you at the DHS office in your state & they will inform you of when you need to show up. Can't help you with e-filing the 765 though, sorry...

10/08/05: NVC receives I-129F from VSC

11/28/05: Medical completed in Dakar

11/30/05: Interview completed in Dakar

12/01/05: Received visa in Dakar

12/22/05: Arrived in the U.S. via JFK & received temp. EAD

12/28/05: Applied for SSN

12/29/05: Applied for marriage licence

01/07/06: Got married!

01/17/06: Received SSN (still waiting for actual card)

01/18/06: Started new job

01/18/06: Applied for Maine state ID

01/26/06: Sent EAD, AOS and AP applications to Chicago lockbox

01/28/06: Received Maine state ID

02/04/06: Received NOA1 for AOS and AP, sent in wrong check for EAD :(

02/06/06: Resent EAD to Chicago lockbox

02/14/06: Received NOA1 for EAD

02/15/06: Received biometrics appointment date

03/10/06: Gave biometrics

03/24/06: AP approved via email

03/30/06: Received AP document in mail

04/12/06: Get immunization supplements

04/24/06: AOS interview (case pending, need another I-864 and FBI name check pending)

That is exactly what I thought. But apparently the e-filed I-765 is different.

If you are filing for AOS and EAD at the same time, I am of the understanding that you should be filing them together through the Chicago lockbox.

If you are a K1 as your profile says, then that's the way to do it. You may need to schedule an INFPASS appointment to get it sorted out.

There are others on this board who can offer further advice.

If this was the first filing for EAD I'm pretty sure you can't e-file for it, e-filing is for renewals.

I'm not familiar with the process but this is what I read. Your web application confirmation receipt or I-797 NOA(paper receipt) should have instructions on whether you need to schedule an appointment or whether USCIS will send you a notice to schedule an appointment.
