Hello Everyone,

I am going to file for a K-1 soon, after one more visit with my fiance in Cuba. I know I will have some more time to think about it, but I am already thinking about the sponsor, and it has been kind of difficult for me to find family support. I am still in search of a good friend with the financial means to help.

My question is this: If I were to be in school and receiving student loans that amounted to more than 125% of the poverty line, would this count as acceptable income?

I am looking for ways to just do this myself, if need be, and this is an idea that occurred to me. Are student loans acceptable as income when there is no other job to back it up?

You're going to get the answer here that 'no' you cannot do this.

But believe it or not, an immigration attorney told me you can.

If you are considering this path, I would consider seeking better experts than you will find on this site.

Loans are DEBT, not income.

There are circumstances where financial aid can be used to help qualify as a sponsor. Examples would be grant money or cash in the bank from loans can be used as an "asset". Liquid assets can be substituted for income on a $3 assets replace $1 income shortfall ratio. It may be possible to use a separately drawn affidavit to satisfy the public charge concerns for the visa but a qualified sponsor needs to provide the I-864 when the status is adjusted.

There are also special considerations for intending immigrants from Cuba that could come into play. I'd see an attorney.

Yes that's true.

But where does the I134 or I864 ask about debt?

The same place it asks about student loans. Nowhere. It asks about income and assets. The proceeds of a loan may be considered an asset before they are spent but they cannot be considered "income".
