My husband wants to get a divorce. In November i have applied for N400, under the 3 year rule(married to an USC) and in December i had the fingerprints appointment. I have not yet received the interview letter when this whole nightmare situation at home happened. I need to move out and i need some information in how to cancel my citizenship application, due to the soon comming divorce. Should i send the letter to Nebraska(where i submited the application) or localy to the USCIS office downtown where i should be having the interview. In case i am called for the inetrview and i am not yet divorced, can i just say to the officer that i might be getting a divorce realy soon and he/she should cancel my application? Would that be too late to cancel? Would there be any consequences? I mean, can i apply on my own 2 years later(i have the 10 year GC)? Please help me out.

You definitely can apply on your own later, since you have LPR status. What makes you think you need to cancel your citizenship application?

Doesn't say anything about what happens if you divorce before your interview!

I guess you can try call the USCIS information service. Can't rely on their answers much tho!~

Am sorry about your situation. DO not cancel your citizenship application. Wait for the interview letter in the mail and you will explain to the interviewing officer. I saw someone on VJ, they had remarried by the time of the interview but were granted the citizenship because it was not their fault (the divorce) and had been married for three years by the time they divorced ( I think... do not remember circumstances clearly). Bottom line, dont withdraw application, wait and see how the interview goes.

Thank you all for the replies. I realy don't know if need to cancel my application since the divorce has not yet happened(but will soon, probably in a month). I'm only guessing that would be the right thing to do...I have no idea. I just don't want to jeperdise my posibility to apply 2 years later, on my own. If i could, i would realy like to have the option to wait untill the interview date and explain to the officer the whole situation and leave it all up to them. I wasn't sure if a denial for citizenship from their part(USCIS) would weigh more(have negative consequences) than a request for cancelation from my part. I guess that's what i was trying to figure out. If you guys say it doesn't, then that is great news! Becoming a citizen would be one of the greatest honors for me.

I have been married with the same USC for over five years now and had the GC for three years.

I think I'd consider making an infopass appointment and ask them what to do. That way you'd be on record of trying to do the right thing what ever that may be.

I would wait and see what happens at the interview, whats the worst that can happen?? You get denied, nothing lost in my opinion!

Best way is to get to the info pass and make appointments and talk to them. No need to cancel your application unless you want to be a citizens. Goodluck!

Thank you very much for the replies. I decided to wait and see, go at the interview when scheduled and hope i will not be divorced by then. If asked, i will tell the thuth, that our marriage is breaking own, but only if the officer inquires. I do want to become a citizen, it is probably the only thing that could make me happy right now.

They're not going to say 'you're divorced you can't ever be a citizen' so go away for ever and ever. They'll probably just say 'I'm sorry, we have to deny this petition because you're divorced and it's too soon to be able to approve it. You'll have to refile when you're eligible.'

Make sure that you notify USCIS on form AR11 of your new address when you move, I would follow it up with a phone call to the 1-800 line a week or two later to make sure they have your new address.

Go to your interview a friend of mine was in the same situation when he went for his citizenship interview he took all the requested papers that were on the interview letter and explained to the office that they were divorced but he still wished to go ahead with the application for citizenship. He was approved because the officer said they has met the requirements of being married for 3 years or more to the same USC and he had been a LPR for more than 3 years. If for some reason you do not get approved that will not stop you from filing again once the 5 Years as a LPR are up.
