Hello VJers! I have had many highs and lows over the last year with the whole immigration process and today was definitely a low.

I am left between wanting to kick a hole in the wall and scratching my head in complete bewilderment.

Here is my predicament, if anyone can clue me in as to what went wrong, please give me a buzz:

My wife (Filipina) and daughter (she is US citizen) entered the U.S. (P.O.E Atlanta with a K3 visa) the week prior to Thanksgiving 2008. I decided to put the AOS process off until after the holidays due to all the craziness that was going on back in December. Right after New Year's, I sat down and started the AOS packet.

I followed the directions verbatim and placed the I-485, I-765, and I-131 in the AOS packet respectively along with a check for $1010 made out to Department of Homeland Security and proceeded to mail it to the Chicago Lockbox. Much to my chagrin, I found in my mailbox today the AOS packet returned to me with a I-797 notice attached saying that the application was rejected due to an incorrect payment enclosed. The I-765 and I-131 also had notices attached stating the correct fees required.

Now this is where I am at complete loss: the instructions of the I-486 said that the $1010 fee was a blanket payment that could be submitted in one check and covered all 3 applications mentioned above. I do not get it, I followed the directions completely and they still returned it.

Should I...

1) return this packet again to the USCIS with another check for $1010?

2) omit the other two applications and just mail the I-485?

3) hire a lawyer?

Any input is appreciated.

Could they made the mistake thinking your daughter was supposed to be paid for also?

They did for us while removing conditions. They didn't see that anak was a USC~

We had copies of her US PP and adoption decree. They missed it! It stated so in the cover letter also.

Did you look over your check again? Could it be missing anything like signature. Did you put 1100 instead of 1010? Do the written words say One Thousand Ten dollars? You know how sometimes you proofread something over and over but totally miss a mistake because you read it like your

brain knows it's supposed to be?

I would call the information line and explain what happened and ask what the correct fee is. Then I guess you have to mail it again if they tell you $1010.

You didn't send documents for the daugher I assume, since she is a USC.

Unfortunately, I have heard of this happening when one sends the total amount on one cheque / money order. Try resending it with 2 separate cheques / money orders. 0ne for 80$ and the other for 930$.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I also sent out one check for $ 930.00 (AOS fee), and one for $ 80.00 (biometrics fee) and it was accepted.

It wouldn't hurt to try and send it out that way. Maybe whoever looked over your package simply made a mistake.

I've read here in the forums that this happened before... but it's not the actual payment to USCIS.. is what u put on your wife's and daughter's birth date..!!

I read in here that somebody put the wife's b-date as if she was born on 2008 and he got rejected due to incorrect fee...

in my opinion check your application again!

Advice I was recently given when USCIS make silly (but oh so frustrating) errors like this was to simply resubmit but with a covering sheet breaking down exactly what you've sent and why, explaining in detail why what you have sent them is correct. Include and highlight the section that says you can submit one check to cover both amounts, that the 765 and the 131 are free when filed concurrently, and so on. Write it as though the person who's going to be reading it doesn't know what they're doing ;)

That happened to us. I think something is up with the PDF when you use it to put in the date...or my version of acrobat. I did it twice actually, the second them they seemed to have caught it.
