Another REAL Nubee Question

I've been monitoring the site and used many helpful tips in getting our K-1 Visa petition together. I just recently re-sent the package, it had been received at VSC, and rejected. Their claim was that I had not signed the I-129F, that it was a photocopy... It was an original signature, the impression from the pen was clearly visible on the backside of the page, but that's water under the bridge at this point. Before sending it back, I noticed a mistake on my fiance's G-325A, and got it corrected and resubmitted with the package. I got confirmation yesterday, from FedEx, it was received at the VSC. My Fiance, who is in China, called me last night and told me she noticed another mistake, that she did not catch before signing it. She is divorced, and I made a typo on the date of her marriage.

So here is the real question... since there is no supporting documents required for her marriage by the I-129f or the G-325A (I know there will be down the road), :innocent: should I wait until I receive the NOA1 and receipt number to try to correct it? The wrong date I entered was 02/24/1994 vice 02/02/1994... still not sure how I fat-fingered that one.

Any advice would be greatly appreciated.

Typo for a prior marriage date should not be a major issue, it is the divorce evidence that matters.

I recommended that you join and use the extensive resources at "A Candle for Love" to prepare for the rough interview ahead, the consulate has been very tough lately with many White Slips for "Not a Bona Fide relationship".

Try calling SC office and ask for their advice. I do not know if it is possible to sign another form and send it in with an explanation latter attached. This will show that you are trying to correct the mistake straight away. Never done this, I dont know,.....

My advice is to do nothing about this error. If it's asked about on a later form, give the correct information. These are not the kinds of errors that cause problems with the process. Calling USCIS is a joke. We don't call it the misinformation line for nothing.

The problem with doing nothing and later giving contradicting information later is that it shows some level of not being truthful. However if you correct the information now then its on record that you tried to correct it before the interview. As long as it doesnt hurt to send a correction, why not do it? Also just make sure you have a record of the correction and an acknowledgement from USCIS. To Some interviewing officers any inconsistency will justify a denial.

Sending something may or may not get to your file, but if you think it will be useful, feel free. However calling USCIS does NOTHING. Honestly, the people don't know the process and when they aren't being rude, dole out ridiculous advice that can seriously screw with your petition if you follow it. They once told me that K-1's dont go to NVC and then put me on the phone with a supervisor since they wanted to get my petition removed from there  I had to do a lot of fast talking to keep them from totally f*cking up my petition. Keep in mind I just called to ask when I was going to get my NOA2 since I'd been approved and we had an interview date but no NOA2. They also couldn't understand why we had been approved after only 3 months (the normal processing time when we did it) when their website said 6 months! Most idiotic people EVER.

You can't really make any changes until you receive your NOA1 because you will need an INS number to associate the change with. Once you receive your NOA1, I would at least try to correct the mistake by either calling the customer service number or sending in a hardcopy of the change. I called the USCIS service center several times and had no trouble. Just use the number that is given on the back of your NOA1 once you receive it.

I really wouldn't 'just leave it unless they ask questions later on' because they will wonder why her husband-to-be was not correctly informed about the date of her previous marriage. If her signature is on that, she could catch some flack for knowingly signing a 'falsified document' even though the mistake was entirely innocent and not really a seemingly huge deal, BAD news if they decide to make a big deal out of it. Since the paperwork is being filed so that she can enter into another marriage, you may want to make sure that the information about any previous marriage is correct.

Best of luck and I hope you can get this straightened out quickly :)
