is passport required to enter the US for foreign spouse

Hello VJers! Since our case is getting to be complete, I am getting nervous and anxious at the same time. I have an issue that perhaps some of you had or know how to deal with it have dealt with. My wife is Somali but currently lives in Kenya. She does not have a passport nor is there any form of government is Somalia at the moment, except civil war after civil war for the past two plus decades. Now a person told me that this person's attorney said my wife will NEED a passport to pass through the customs once she enters US soil. Is this true first of all? And secondly, if that is the case, then do you go about this situation? Where am I suppose to get a passport from for her? Will Kenya give her a passport on behalf of Somalia? Is that even possible? Should I contact the NVC and inform them of this situation and heed to ther advice and suggestion? Or will they make an exception in this case since there is no government appearant in Somalia as far as I know? Please help me find the answers to these inquiries and troubling thoughts. "Since our case is getting to be complete?" Where are you in the process? Normally to have a interview one must have a valid passport.

Also need a copy for NVC process

I think you will need a passport. Ask her to find out if there is a Somali embassy in Kenya. The embassy should be able to help her process a passport. Try finding out if there is an embassy in Uganda and Tanzania as well. The Somali embassy in any of these countries should be able to help. Since there is some sort of government in SOmalia right now, I think they have representatives in the rest of East Africa, especialy Kenya. Also you might want to call the US Embassy in Kenya and ask them how they deal with Somali cases. I know that they process other cases from Somalia, so there must be a way that those people get passports or "waivers" if at all apllicable. Take care and all the best.

Try finding out if there is an embassy in Uganda and Tanzania as well. The Somali embassy in any of these countries should be able to help. Also you might want to call the US Embassy in Kenya and ask them how they deal with Somali cases. There is no embassy...there is no govt. Its just a bunch of warlords.

You will need some kind of passport to get a visa. See if Kenya issues refugee passports, or if the U.N. offers them, or if the US Consulate offers travel letters.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I found this link but do not know how accurate this information is or if these embassies are still open. You might want to call them and ask if there is any Somali consulate in East AFrica...... You might want to call NVC and see what they say but also call the US Embassy in Kenya.

Unavailable. There is no competent civil authority in Somalia. The Government of Somalia ceased to exist in December of 1990. Since that time the country has undergone a destructive and brutal civil war, in the course of which most records were destroyed. Those few records not destroyed are in the hands of private individuals or are otherwise not retrievable. There are no police records, birth certificates, school records etc., available from Somalia. There are no circumstances under which immigrant visa applicants can reasonably be expected to recover original documents held by the former Government of Somalia.

Passport and Other Travel Documents

The Department has determined that Somali passports are no longer valid for visa-issuance purposes. Most immigrant visa beneficiaries will not require a passport. Somali nonimmigrant visa beneficiaries will require a passport waiver.

I have kind of read up on Somalia passports on the internet, but there are alot of forgeries especially in Kenya. But the government (It is not a fully functional gov't because it controls a very small part of the country and the rest of it by warlords) Anyway the government launched new e-passports and am sure there is some sort of office in Nairobi, Kenya because almost all the negotiations and alot of somali "government business is conducted in Kenya. Also there are many refugees in Kenya so there must be an office that helps them besides the UN. Otherwise see if you can get travel documents from the UN.

Somalia launches E-passport

The Somalia government has launched the first phase of the new E-passport.

The passport is a technological advancement for security matters.

Speaking during the luncheon the general manager for the Just Solutions

Passport Agency Company, Stephen Robert, says that the E-passport, which is

accompanied by an E-ID, will protect individual security for its citizens as

well as expanding its economy.

Somalia Deputy Foreign Affairs Minister Hasan Ahmad Jama says that the

E-passport will assist in identifying criminals at border points and allow them

travel without restrictions all over the world.

If your fiancee is a UN-recognized refugee in Kenya, you should be able to get travel documents issued by the UN or the Kenyan government. Where are you in the visa process? I would suggest contacting the embassy in Kenya where she will be interviewing and asking their advice. The US is not new to the idea of refugees without papers and as you are applying for a different type of visa they may have special information for you.

Wow. plenty and ample of info there. Thanks bunch guys.

Now as for the case being "close to complete", I am not sure if it is close, to be honest with you here, but we received the AOS and IV Fees and paid already. It is still pending, however. After the payment clears, which I paid online btw, I think they will then send the packet.

But anyway, about Somalia, like desert_fox said, there is no gov. in Somali, nothing...." Its just a bunch of warlords."

But I will show that link and this information to the attorney and see what he says. Thanks again guys and take care.
