Correcting CR1 to IR1 on GC

I received GC with wrong status (CR1 even if I was admitted after 2 years of marriage). I got so many different directions how to correct it that I am getting sick. On Infopass they told me to send I-90 with supporting documents. Over the phone they told me to write district director and ask for secondary hearing before sending I-90. On another forum they told me that none of this would work and that ONLY Customs and Border Protection can correct the status!

I would like to hear some real life stories and if anybody fixed this with USCIS.

The correct procedure is to send file an I-90 to correct USCIS error, there is NO fee for this, you need to attach copies of supporting evidence (Copy of passport showing entry date stamp, and copy of marriage cert, along with a cover letter explaining the error).

I do not want to bore anyone with this subject, but I am just freaked out by different information coming from the same official source (USCIS), and after all those mistakes and waiting, I am so terrified by the idea to send the GC back since they may lose it or something.

One more question...does anybody know how much time do I have to send I-90 and ask for the error correction?

I would file it ASAP.

The phone operators at USCIS are known for errors.

From USCIS:

If your card was issued with incorrect data due to USCIS administrative error, you must mail a new I-90 application using Application Reason "d" My card was issued with incorrect information because of a USCIS administrative error, and any supporting documentation, to the USCIS Service Center/National Benefits Center(NBC) that processed the application/form from which the incorrect card was created. Check the envelope that your I-551 Permanent Resident Card came in to find the mailing address of the Service Center/NBC that mailed you the card. The Service Center/NBC address can also be found on the I-797 "Notice of Action" issued for the application from which the incorrect card was created. In addition to the new I-90 application, applicants are required to send the original I-551 card containing incorrect information, plus the supporting documentation for the requested correction. A replacement application based on a USCIS administrative error must also include an explanation.

There is no fee required. Total filing fee - $0.

Thanks a lot YuAndDan. I will probably send I-90 by Friday (just want to see if anyone from the district office will reply since we did request a meeting).

It is funny how things add on. I was reading I-90, and two other questions appeared.

1)Should I check that I am a permanent resident or conditional resident? (theoretically, I am permanent, but they registered me as conditional and I am complaining about it)

2) Is international version of marriage certificate good enough? (yes, it has English and 20 other languages, but they only have to turn the other side)

according to USCI website..

"Your permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or receive adjustment of status..."

I've seen a lot of people saying that the 2 years count on the day that you submit your application, or the day of your interview, or this or that, which are all wrong... the 2 years count on the day that u were admitted on a marriage visa or the day your AOS was approved. Check your green card, where it says resident since..., I never really looked that rule up until recently, now it's time for me to remove conditions but believe i was given conditional residency by mistake. I was grated residency on Marc 13, 2007 (gc expires on march13,2009 and have nor applied yet.. ouchh) ...but was married on Feb.10, 2005. So what to do? I-90?
