I understand that a new law has been passed relating to criminal background checks as part of the K1 visa process. What is that all about. Seems like an invasion of privacy to me. All I want to do is get married. I'm not asking for a job with the FBI or some other top secret government agency

The international marriage broker act passed in March. It affects all K1 petitioners will filed after March 6, regardless if you are male or female and regardless of how you met your fiance. In a nutshell, it requires the USC to provide "possible" background information that same as the foreign fiance is required to do.

When the law passed, DHS did not have the correct form available for people to use to file. As a result, everyone who filed after March 6 is on hold until they create, approve, and distribute the form to USCs. That's what the 75 page threads here on IMBRA are all about. Unfortunately, it's part of the process whether we like it or not. (It seems most of us don't care about the need to provide the information - it's the enormous ####-up and delay that has us upset).

The issue is not you getting married or who you do it with. The reason for further investigation of the USC (USCs already have some criminal checks run on them in the petitioning process) is because you are asking the rest of America if it's OK for you to bring a foreigner here to be a resident.

In that case, it's not an invasion of your privacy.

You do have to consider why IMBRA was passed. It was an amendment of the Violence Against Women Act. It forces disclosure of the petitioner so there's no surprises for the unsuspecting fiance and protects them against potential abusive relationships.

I know it seems like an invasion of privacy but its for a good reason. Its just one hell of an inconvienience. When I found out about my petition being returned and why I decided to try and do my best to shorrten the potential wasted time. I went to http://www.fbi.gov/hq/cjisd/fprequest.htm ans initiated my own FBI criminal background check, just in case they wound up requiring me to provide my own proof. It's only $18, they say it takes 8-10 weeks to get but you can request it be expidited. I got mine back in 3 weeks, and now am ready and armed just in case.

If you have been convicted of a crime, it is not an invasion of privacy. Any plea or conviction in open court is public information.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
