Hi everybody,

This site is great! The paperwork for this process is killing me, but this website has been such a help.

I think I have read that form I-134 (affidavit of support) is not required at the London Embassy for approval of a K1, but that they do want assurance that my fiance will not become a public charge upon entering the U.S.

I have recently learned my petition has been approved, so we are getting ready for the next step. Is what I heard about the affidavit of support correct? If so, what kind of evidence will they be looking for that my fiance will not become a public charge once we are married, if not this affidavit?

On tuesday they took from me, the affidavit of support (notorised, think it was form number i-134) a copy of the letter from my Fiances employer stating how long he had worked for them that he is a permanent employee and earns around.$.... per year, and even though i had his w2s and 1040ez s for 05 06 and 07 they only took 07. i beilve they want to see the i-134 from you if you are sponsering him.... not sure about self sponsership but thats not common, think some have done it here though, and you need to prove enough liquid assets.

even though it was worded a bit like a suggestion, i havent heard what else one could use in its place and its ment to be a contract of sorts where you promise your fiance wont become a charge and is your financial responciblity. i havent yet seen anyone post that they used otherwise. so i assumed it was nessersary. you need one from usc (fiance/petitioner) and if using a co sponcer they need to do one aswell i think.

By the way, this is the information from the London Embassy site that had me so confused. It does not say anything about the I-134:

Evidence of Support: An applicant for a fiancé(e) visa is not required to file an affidavit of support, form I-864 at the time he or she applies for a fiancé(e) visa. However, the Immigration and Nationality Act does require the applicant to establish to the satisfaction of the consular officer at the time of the application for a visa, and also to the satisfaction of an officer of the U.S. Citizenship and Immigration at the time of application for admission to the United States, that he or she is not likely at any time to become a public charge.

Ok I will double check the form number of the one I used but there is two, the one in that excerpt is I think more legally binding that the other in some way as it comes after the one I used. And is required at aos, but not manditory for the interview, then there is the other one that u provide at interview if u don't submit the one u found and I think it's called the I 134. If this one is used at intervew the other one with 8 in the number must be submitted at aos. I don't entirely understand why there is two forms for the same thing or what differs btween them I just know that they are contract between sponger and us gov that immigrant won't become financial responcibility of the us gov and if they do sponger has to pay them back untill certain criteria are met. I.e. Citizenship and something about working quarters.

There should be an example of the I-134 in guides above and u can find the up to date from on the uscis site.

I think what they mean is u have to submit an affidavit of support but you don't have to submit the one u found for k1 interview. Perhaps it's different for spousal.visas, I don't know.

This London Embassy page mentions the Affidavit of Support. http://www.usembassy.org.uk/cons_new/visa/iv/faffidavit.html

Go way down the page under the heading Affidavit of Support and they mention the I-134 or how to write your own affidavit. When you read all that must be included in a "write your own statement", you realize it's easier to just use the I-134.

It is a new form now and no longer has to be notarized. There are separate instructions for it so download both the form and the instructions from USCIS http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD
