Hello! I am wondering on behalf of my brother who has also gotten his approval today. His wife has been married previously and so has he. Is he to supply her divorce documents in packet 3 or just his own? Also, what should he provide as proof of marriage is this needed for packet 3 or only at the interview? He had sent pictures in when they sent in the I-130 and I-129F packages. Also, very important question: if you filed K3 and they send the I-129F package to NVC and your photos are in that package do they go to the embassy or do they stay at NVC? This is very important to know. I need to know for me and my wife what we can start doing now that we have our NOA2. She called to get hte case# and I did not talk to her yet because she is at work, but I suppose she got it from them already. Any help would be kindly appreciated!

First of all .. K3 is what you call I130 With I129f and you dont send that to NVC you send it to your Designated service center...

Dont send them anything unless they ask for it. Just make sure u send what is required to be sent.

If they want to see the Dicorce Document ..they will ask.. but its better to bring it to the Interview..

If u have the Noa2 send her the Package ..

What to send to your Spouse once the I-129F is approved (NOA2):

1. A copy of the entire I-129f and I-130 package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2. I-134 / I-864 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require one or the other forms. You will need to verify with the consulate which they require. You can call or email the consulate to check ahead of time. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Attempt to start collecting the required information ahead of time, as it can often take several weeks to collect it all.

3. You will need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these asap after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134/I-864.

4. A copy of the NOA2 that you received in the mail.

My understanding is that the WHOLE packet is sent to the embassy. So, any supporting evidence you sent will be included. Please someone correct me if I am wrong here.

The proofs are to be brought to the interview. the packet 3 is really just the med and police requirement instructions and all the forms

How can they send the entire packet though if our I-130 will most likely still be pending by then? I don't get it. Do they send all of it and wait to approve the I-130? This don't make since to me.

sorry, i didnt clarify the whole 129f packet..not the 130.

which sucks in our situation because all of our proof was in that one, so i'll be sending it again.

Ok, now my mind has gone haywire! Are you serious? Are you all saying they do not send our evidence to the embassy? Ugh! This totally sucks! I do not even remember what all I included in there as evidence. I guess I will get a download of my complete package from my attorney. Should that suffice?

He should not enclose HER divorce decree in the Packet 3 but he should provide a Copy of HIS divorce decree and a proper translation... He maybe asked to show HER Original divorce decree at the INTERVIEW!

he is not required to provide -- in the packet -- more than what is mentioned on the list the embassy sent him... The proof of relationship has to be taken to the interview! (Pictures, phone bills, chat logs, e.mails .. etc)

it was a mistake that he sent pictures withing I-130 and I-129f Packages and I guess they'll end up in one of the trash cans in the National visa center (Sorry!) the visa is being sent electronically to the US. embassy in your country!

FOR YOU: you can start doing your medical examination + get police certificate (Translation) + Pay visa fee and get the receipt + get the military documents translated make photo copies of your passport and take pictures!! good luck

ya, there are people who dont send ANY proof with the petitions and get approved...me,you..we went overboard and now have to do it all again cuzz we're doing k3 heh

No big deal really, if you have access to the whole packet, then jsut get it and send to the husband

Hi,

I guess every country is diffrent, I did my package 3 for my k3 visa this week and I got all the forms they sent me but the only ones I had to send back to them was the DS-230 and a check list that had to be signed and sent back to them to set up my interview date. The other forms they sent I was told to fill out and bring them on the day of the interview. Hope this help.

NVC will forward everything you have included in your petition to your respective embassy. They won't dump it.
