hello,

one more question about affidavit of support for a K1 visa. just to clarify, I will bring an affidavit of support during my interview right and he doesnt need to notarize it anymore - according to the new rule, right?

second question, we received the NO2 yesterday and was thinking my interview might be in a month already. We wanted to prepare all the stuffs that we need already and all we are waiting for right now is the affidavit of support. w2s for 2008 are not in yet so he cant file for his income tax return for 2008. Although he has a business in guam that he is paying taxes every month that is enough to 125% of the 2008 poverty guidelines with all the pay stubs until october 2008.

He doesnt have pay stubs after oct 2008 til the present since he is here in the philippines with me and wanted to be with me during my interview day. However, he is making money out of his business in Guam and is paying taxes as well. what do you guys think, what does he needs to show during my interview if he has no work since oct 2008 up to my interview day since the Income tax return for 2008 is not filed yet.

is there anybody here in VJ who is from guam? bec my fiance is paying taxes every month depending on how much money he make for his business.

I hope you guys can give me some answers.

2008 IRS taxes are not due until April 15th, 2009.

W-2's, 1099's, etc employers and companies have until Jan 31st until they have to be mailed out.

so for the moment, he can show his income tax 2007? but how if that cant cover the 125% of the poverty guidelines but the earned income that is not filed yet for 2008 met the requirement, what can he show?

He needs to get hold of employeer or companies he has worked for and ask for W-2 and 1099's for 2008.

As soon as he has them in hand he can file taxes for 2008.

Employer letters work too, showing his prospects for continued employment, and expected salary. Our friend just had her interview. The sponsor just took a new position, and the employer letter clenched it for her. She sailed right through.

Hi,

I have the same issue. My husband's 2007 tax didn't meet the 125% poverty requirement for a household of 3 (including himself). His tax for 2007 filing status was single and has no dependent, however in our I-864 we include our son as dependent :( He told me his income for 2008 meet the poverty requirement and filing not due until April 15? I am scheduled for interview on Feb23. Is it ok if he will just photocopy w2 and 1099's once he got them and send me a notarized copy of his certificate of employment? We are currently reproducing I-864 as he do not have a copy when he submit it to NVC. Thanks!
