what happens if your out of status?

hi,

just wondering....i am currently engaged to a USC and i am here in the states on a TN visa which expires in april.if we get married and apply for AOS before my TN visa expires...what happens to me while the AOS is being processed.im not gonna get deported am i?I know the AOS takes at least 6 months and the EAD takes at least 3 so if we put the AOS application in in march,that means the earliest i can get the EAD will be june and my TN wouldve expired by then so is that what it means that im 'out of status'?and so what happens to me...am i an illegal alien?thanks in advance for any replies.

To my understanding, once you marry the USC. You will not be out of status once your TN expires.

Once you file for AOS. Your status will be pending, you will need to file forms I-765, I-131 and I-485

The total fee is $1,010.00

I am not sure but you may need to file an I-130 concurrently with your I-485

likely as well, if you get married now, you can apply to extend your EAD online and likely wont have a lapse in your status.

Marriage to a USC does not give you any special status or keep you from being out of status. The AOS application does keep you from being out of status. If the AOS is filed before the TN expires, you will not be out of status. You will need to file the I-130 along with the AOS application.
