My interview is done an hour ago, but the consul returned my passport, and she gave me a paper that I shoyld returned back to the embassy on Monday - Thursday to submit the papers.

Consul said that the income tax is not enough for 5 dependents, 2007 income tax shows that the income is only $15,000 and they need $31,000 for 5 dependents.What should I do now.Pls i really really need your advice on what to do in this matter.

Was your 2006 income tax sufficient?

One things you can do is to submit also your 2008 wage and earnings statments, Did you try that?

Consul gave me 3 papers.it stated that'Petitoner should present sufficient income of $31,000 for 5 dependents.

In his 1-134 affidavit of support its $30,000.but the consul said that she needs income tax. My fiance is a US Army but she said that it is not 100% above poverty but it should be 125% above poverty level.

Confused on what to do,My fiance is in Iraq.

There was just a post two days ago where the woman said the embassy took co-sponsors. :blink:

you are in difficult situation, considering your fiance is deployed right now it will be hard for him to find another job to add up to his present income. The thing is, your fiance has to come up with another source of income so he can meet the the criteria.

Yep, that's how I read it. Manila USEmbassy website only mentions joint/co-sponor for the I-864, IR/F/E visa catergoires:

Form I-864 Affidavit of Support (AOS): The I-864 AOS is required for visa applicants in the IR, F and certain E visa categories complete with copies of your sponsor’s latest U.S. Federal income tax return (ITR) and wage statements (Form W-2s). Please note that your petitioner must provide an Affidavit of Support, even if they do not meet the income requirements and even if a joint sponsor’s Affidavit of Support will be providing all of the actual financial support.

There was no mention of co-sponsors being allowed for the I-134, SB-1, K1/K3.. :

Form I-134 Affidavit of Support: The I-134 Affidavit of Support is required for returning residents (SB-1), fiancé(e)s or spouses of U.S. citizens (K1, K3), children of K1 and K3 applicants, spouses and children of lawful permanent residents (LPRs), applicants with special immigrant status, and follow-to-join derivative family members of employment-based (E) applicants. A copy of the sponsor's most recent Federal income tax return (Form 1040) should accompany the I-134. Faxed copies of the ITR are acceptable.

But then agian, I've seen people say they were allowed co-sponsor, but not sure, as I probably didn't pay attention to the type of Visa they were applying for when I read their post.. :blush:

This is a tuff situation you're in, and since the CO stated you needed to provide papers to support this requirement, I'm thinking they might of put a comment in there stating this and it would seem hard for another CO to overlook it.

As mentioned before, can your fiance submit 2008 salary that might satisfy their requirment??

There have been thousands of K1s approved using a co sponsor. It's used to be an exception when someone is denied using one. Seems like it has been happening more more recently tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I'm always confused as to why come to the US if the petitioner is not in country. It is a lot less expensive to support a beneficiary in the RP than it is in the US so best stay in the RP for now.

Isn't there some way to keep the K1 active while waiting? I know the visa, once issued, is good for a year, but I'm not aware of any hold/pause period that can be applied.

I know it is a sad time for you - very sorry for the unhappiness that you must be feeling. I hope it works out for you in the end. If you aren't worried that your fiance might change his mind, if you are secure emotionally, unless he has family that is willing to take good care of you and the other dependents, you are likely better off in the RP for now. Living in the US is no walk in the park, that is for sure.

I don't know where you plan to live but supporting 5 people on $31K is rough. Have you and your future husband discussed this?? It seems you didn't understand the requirements before you started the process.

Looks like you need to wait for him to return from Iraq.

Yes, it is not a good day for me.I just need peace of mind.My fiance keep on telling me that I dont understand him, his kids are not totally dependent to him, they live with their mother,and he pays child support.He lives alone, so he dont have custody of the children.

My family is in the US, and I dont want to tell them what happened today.

I need space today, and peace of mind
