Hello, I'm totally new to this whole K1 visa process, but after reading on this forum and other sources, it seems like K1 is easier to apply and requirs less evidence to prove the relationship instead of CR1.

Just have a couple question: We met the first time in early Nov 2008 in Hong Kong, and started dating since then. We are so similar and so in love that he actually asked if I want to marry him in mid-December, 2008. I answered yes, and I think that made us officially engaged. Is this going to be a problem for our visa process because we have only been dating for a month before we are engaged? We probably won't be starting the K1 process till later this year because he doesn't have any passport yet, and he's saving money for passport and all the other process, should we tell the office that we are engaged in Dec 2008, or should we pick another date so that the officers won't wonder why we got engaed so soon?

I'm a US citizen, and he's in Hong Kong, but born in China. He's also a few years younger than me, is this going to affect our application as well?

Also, his English is not that good, anyone know if it is possible to get an interpreter for the interview in Hong Kong Embassy?

Thank you very much. I also am thinking maybe I should just put in the paper work now for K1 since it will take a while for it to be processed anyway, and maybe he can just make sure he has a passport before the interview, will this work?

your prob talking 9 months to a year for interview so by then he would have passport surely. K1 would be if you stay single to marry here. Age will not matter that much, he prob can do interview in whatever language he is most comfortable with. THe thing is keep your proofs of time together, both free and able to marry, at this point just proving you have met within the last two years, free to marry and continued relationship. Possibly get another trip to visit in it always helps

Agree with the above poster. At the initial application stage, all you need to do is prove you have met within the last 2 years and are free to marry. It is at the consulate interview that you answer questions about a "real" relationship. You will have plenty of time to visit more and get to know each other better between now and then. Plus considering the short duration of your dating, it will give you both the chance to grow your relationship. Just make sure to document everything (letters, trips, e-mails) so you have it for the interview.

I'll try to answer in order...OK maybe not in order.

1. K-1 is easier and faster than CR-1, BUT you have to go through the AOS process here after you are married. Not so difficult and you get to be together while you do it.

2. No one cares how long you have known each other

3. No one cares about age difference.

4. the people at the Hong Kong embassy will speak his language

5. He doesn't need a passport to apply for K-1, but he will need it at the interview which will be, probably, 6 months down the road. I would apply now. If the day comes you have an interview and he is waiting for a passport still, just postpone the interview.

During this time, keep every "evidence" of your realtionship...travel documents (itineraries and ticket receipts do NOT cout, they will ONLY accept a boarding pass with corresponding passport stamps) email logs, phone bills, photos together, etc. The more the better.

 It is very important to show an ongoing relationship. How do you communicate, can you speak his language? If not do you have any problems communicating? Communication is an issue about the relationship.

While I don't want to burst your bubble, I have some questions that you don't have to answer but which might influence how you want to go about the process. While you may have read the guides, another good thing might be to look at what Consulate or Embassy he might be interviewed at and see what others have reported on their interviews..how it went, what questions they asked, how hard or easy the interview was. Clicking on your country map will assist in seeing other VJ'ers who have been, or who have gone through the process from that country. You might also want to check out the regional forums, to see what others have posted from Hong Kong, or China, to see what kind of questions or concerns they might have.

Some of the things I'm thinking....

Is it easier to get a K-1 than any other types of visa from this country?

You say you met in Hong Kong but he's from China. What country would be dealing with the visa interview? Was he visiting Hong Kong? Is he working there? Would his interview necessarily be there?

You mention his English. How do you communicate?

Can you go to the interview?

You mention there is an age difference. How much? Some countries don't scrutinize this, some DO.

Does he want to visit the US before you begin the process? Can he easily do this even when he has a passport? Or are you just thinking of the passport issue before the interview?

Are you going to be going back to visit with him again before you send in the papers? Even after? Some Embassy's do look at the number of times you've met during the process.

Again, I can't answer for the Embassy or Consulate that he'll be interviewing at. It's easy to say with a blanket phrase that all you have to do to be eligible is to have met once within a two year period, and make enough over the poverty line to support that person, however there are still so many ins and outs that are unique to certain countries that it warrents some more information.

Do some more reading, and check into a few more things before making a decision on how you want to proceed.

All the best! (F)

all replys are good BUT in the end do your own thinking, dont take anything anyone says a the RULE.

Each case will be differet, there have been some to meet and marry same trip got/didnt get visa, those who have actually lived in same home as married for years not to get the visa. I have seen some cant talk good english and those that talk none, As long as the couple talks same. Again with the time some, one trip, some 4-5 trips some get visa some dont. Age they say they arent supposed to consider BUT they do they just dont call it that when they return.

Visa u want depends on do you want to marry now or wait for him here. So much to consider, to us our lives seem normal, on paper to the interview they start to invision things. I went one time came home filed k1, one trip, age difference, i had divorces, he has good english they returned. I went back married refiled, now only 2 trips still, same age, same divorces same english and they ok'd immediately so it just means do whats best for you and be prepared for anything

I was born in Hong Kong, immigrated to the USA in year 2000, and became a naturalized US citizen last year. We communicated in our first language -- Cantonese Chinese with no problem. He was born in mainland CHina, but immigrated/moved to hong Kong when he's about 9 years old, and has been living in Hong Kong ever since. I think he is a permernanet Hong Kong resident as well.

I am going back to Hong Kong to visit him again in Feb. 3 for about a week. This time we will make sure to get some photos of us together and I'll make sure I save my boarding pass. I don't have the bording pass from my last trip, but I do have the stamps on my passport, as well as hotel receipt in Hong Kong.

Hope this will help in getting more suggestions from you guys. thanks.

Sorry, please disregard the above reply...more details follow. Thank you.

He is only about 3 years younger than me. I do plan to go back (if possible) for his interview, but I'm not sure if I will be allowed in. I also would prefer to be with him on his flight to USA as well. IT would mean a lot for the both of us.

It's kind of difficult for him to get a tourist visa to USA, but I am planning to go back to Hong Kong about twice a year anyway.

Hope this will help in getting more suggestions from you guys. thanks.
