Already have EAD how to get married and change status

Ok first things first...

I went to school in Kentucky with my I-94, I am now on an extension to that since I graduated with my OPT (optional pracitcal training) and I have an EAD (employment authorization document).

I am wanting to marry my fiancee who is American and I have lived with since I started to work in the states. We are planning to marry in the next month. Once we get married what should I apply for to stay here past the time that my EAD expires, which is in May???? I don't want to stop working so I want to apply as soon as possible to have my documents changed over without any gaps.

Any help would be greatly appreciated! It is a confusing process! :wacko:

My OPT was expiring in May and I applied for AOS beg. of February. I cut it very short, less than two weeks in between both EAD. It takes about 90 days for the EAD to be processed.

AOS Approved on 10-17-08 (details in profile)

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.

How long does it take to get your perm. resident card usually? How many months am I looking at approximately? Thanks for the help!!!! :star:

If it moves flawlessly, allow 6-8 months from date of filing to get the Green Card.

Ok so it looks like I am going to just be applying for my EAD card because my OPT status expires in May and I don't have enough time to wait 6 months!

Now if I already have an EAD card but it is under my OPT status what forms do I need to fill out?

The cost of the EAD is included in your AOS. There is no reason not to apply for it.

You need to apply for the AOS in order to qualify to receive an EAD.

The forms for AOS(I-485), EAD(I-765), AP(I-131) and you must filed these applications concurrently with I-130, Petition for Alien Relative..you can download the forms from here:
