Hi All,

I have been reading your posts for quite a while and you seem very knowledgeable. I want to get your insight in my case. Here is my story:

I came to the US on a student visa in 99. Went to school till 01 and dropped out when I met and married a US citizen. She was a liar, cheater, never worked, and caused me to stop going to school and support her. I was not very aware of immigration laws/rules and decided to do my green card papers myself (she of course didn't have no income for the 864). I couldn't find a joint sponsor and we went to the interview when they told us to bring the 864. I still couldn't get a sponsor. So a couple of months later, they called us for a second interview, and by that time I had had enough and told her it was over and she moved out of my house (house)and went back to Texas. I went to the interview alone, and they denied my application. Lawyers told me I could reopen the case or appeal it, but I didn't wanna have anything to do with her. So i said no...Fast forward, 2006. I met a wonderful girl, with her life together. We got married in May 08 and applied for AOS. Unlike the first time, we have bank accounts, insurances, car title, lease, plane tickets, 864, pictures jointly. But I am still very apprehensive about the interview because of my first case AND because of an arrest for working in a shop that was selling counterfeit stuff. I was only a worker there and I plead guilty to disorderly conduct back in 06.

What do you think about my new case? Are my worries legitimate? Will I have a tough time at the interview?

I think an attorney is definitely recommended for this type of case, if nothing but to protect yourself

01/15/2008 - Proposed

03/15/2008 - Married

09/02/2008 - Sent AOS Package (I-130, I-485, I-693)

09/03/2008 - Received - Signed by SMITH

09/04/2008 - Checks deposited

09/10/2008 - Checks cleared ($1010 + $355)

09/12/2008 - 2 NOA's received (I-130, I-485) - Dated 09/08/08

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

I have an attorney, but there is not much he can do at the initial interview.

Also, the first case was denied because by the time I got called in for the second interview, me and my wife had separated and I didnt wanna go with her to just get the green card. So I decided to let it go.

I never was in removal proceedings.

Then he will be able to advise you the best, this is not a normal case that most people will have experience with

What did your lawyer say? He should have the answers to these questions.

I don't know too much on the criminal history part, but as concerns past cases i think it is best to know exactly where the case stands as it might affect your new case.

Did you ever receive a NTA? Hopefully you were not deported in absentia.

Hope I'm not trying to scare you, but if I were you I'll want to have as much info as possible b4 going to the interview.
