Is there some thing wrong with telling some one they are wrong when they are wrong? This person obviously wants to beat the system. Maybe I should just sneak my wife over the boarder and then get a USA marriage and have her stay? I dont think so.

Its fraud plain and simple we know the OPs intention I would imagine USICS will too. Wrong is wrong and getting a lawyer to beat the system isnt any better. I pay alot of money to do it right and legal. I have spent alot of time and money and heart ache to do it the way its supposed to be done. We all could get lawyers to convince them that that wasnt our intention to be illegal but still we would know in our mind what the real intention was. Getting it passed through doenst make it right.

I still say no matter the situation go back home and wait your turn just like the rest of us, and when its aproved then come back. Why dont we just bring loved ones over and then adjust? Becasue we know that we follow the system becasue its the right way even though it sucks, its the right way.

The OP indeed has intent to immigrate - hence what he is planning is -daaah- planned. Illegal, fraudulent, etc. But please carry on feejo, and here's a toast hoping you get caught and banned for trying to circumvent immigration law. VJ sheesh

If the OP had prior intent at entry is not for us to judge, that is the job of USCIS officer that will be adjudicating on his or her case. As we never really know the full story on VJ members should not resort having a go at the OP because they have judged that he/she is commiting fraud. You have stated that you think the OP is commiting fraud and you are entitled to your opinion but leave it at that.

I think you'd be fine doing this, as long as you genuinely had no intent to stay and can show you were planning on returning. I came to stay last winter for a few months, then we got married after 60 days and we adjusted status. I was a freelancer and winter was my slow time so I had no problem leaving on a three month vacation! But I did show I had a mortgage and contracts booked for my return.

It doesn't really matter if your intent NOW is to get married but wait three months, as someone previously mentioned. It matters what your intent was when you entered. I have heard that there is a 30/60/90 day rule, where your case is more closely scrutinized before 30 days, less so after 60 and even less after 90, but I think, from what I have heard, it is just a kind of guideline. I have to admit, when I did the math, we decided to wait one more day till it was 61 days, just in case, but I don't really know if it made a difference.

Another misconception people have is that you will get denied if you have a relationship before you entered the country. That's not true. We were engaged with a wedding date set when I came to visit. A wedding date far into the future! The onus is on the officer admitting you initially to decide if they feel you are planning on returning.

Good luck in deciding what to do! You are not skipping the line or doing anything wrong, but you have to decide if it is the right path for you. I can tell you that there were some problems I didn't think of when I could not go back to Canada for 6 months. Just financial things that were hard to sort out from the US, things to do with my car, and some family stuff I missed out on. But all in all, it was a great choice for me.

I got a emplyer letter saying I have my job back home, I have plently at the bank. They question about it on the border potrol, but they decide it was ok for me, and din't find that I wanted to overstay or immigrade. They allow me to stay 5 months, that was what I planned. I arrived on nov 05, and will leave on april 5th to go back. That was my plan, not to get married. But I don't have a mortgage.
