Hi all,

First time poster but have been following this site for a long time. Apologies if this has been posted in the wrong place.

My fiancee and I have been going through the process of our K1 visa for a long time now (we have a lawyer working on it for us and originally sent information to her in 2007).

Finally in August 2008 our cheque was cashed and by November we had a case number so we could check our case online at the USCIS.

Interestingly, in December 2008, we received an email saying our case was on hold pending further information. We finally got hold of our laywer on the 6th January and she explained that they needed the following information:

Our passports cover to cover (which we orignally submitted)

More photos (the ones we sent with the date and time on the back were rejected - this may have been because they were all digital print outs)

More evidence of our ongoing relationship from 2006-2008 (in the form of what we had been doing in that time, any times we met and who was with us, their address and details too)

Ticket stubs for plane journeys and train tickets etc.

More receipts for gifts

interestingly, all of our emails we sent were rejected and our lawyer said that the USCIS say they are no good anymore.

Our lawyer is then going to write another affidavit for me to sign in the uk, get signed by a noter and send back to be delivered to the USCIS.

We are a little confused as I am positive this is the kind of information the embassy in the UK would ask for during the interview.

Has anyone heard of anything like this happening before?

Regardless of it seeming a little strange to us, we have submitted all this information that has been requested, as it seems the sensible thing to do.

Like others we are naturally getting a little frustrated with the whole process and just want to be together finally.

Did you actually see the RFE from USCIS or is this what your lawyer is telling you that you need? I've not ever heard of on-going relationship evidence (like pics) being rejected or requested by USCIS. Pictures are secondary evidence and really, with Photoshop I could put you with anyone at any time. Perhaps your lawyer is just trying to cover his/her @ss?

It sounds like they want more concrete proof of having met in person in the last two years. A very common reason for RFE. Passport stamps, itinerary, anything that proves without a doubt that you were together.

She is telling us what we need. We haven't seen the RFE, however I think based on what you have said it is probably worth asking our lawyer to forward it to us. Thanks for your help and speedy response :)

Are your sure your lawyer sent it all the first time?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Then it took 3 months to get the case number??

USCIS saying the photographs were rejected??

Sorry, but it all sounds fishy to me. Do you know why there was such a delay on your lawyer sending off the paperwork? Requests for more evidence of meeting is common, but they wouldn't tell you that X was rejected- just that they want to see more stuff. Your case shouldn't take too long once that happens.

I hope you work it out quickly.
