hi i just want to make sure if i can file my citizenship Feb.18, 2009. i got my 2 yir gc may 18, 2006. and i am married to a us citizen.. thank you...

Yes , You can.

If you are applying based on five years as a Lawful Permanent Resident or based on three years as a Lawful Permanent Resident married to a U.S. citizen, you may apply for naturalization up to 90 days before you meet the ''continuous residence'' requirement. You must meet all other requirements at the time that you file your application with us.

I haven't read anything about subtracting the days you have been out of the country. In fact, we were out of the country for 3 weeks, and still applied 90 days before the perm res card and they gave it to us. We didn't wait 3 extra weeks. Is this written somewhere or from experience?

Physical Presence in the United States

“Physical presence” means that you

have actually been in the United

States. Most applicants must be

physically present in the United

States for a certain number of months to

be eligible for naturalization.

You just don't want to reach your interview and then have them tell you to hold of for a few more weeks so that you actually reach your 3 years because you were not physically present in the US . As far as I know, you have to be physically present in the US for 3 yrs or the 90 day rule. Any days outside the US including Canada and Mexico are considered outside the US. Better safe than sorry :yes:
