Hello,

I'm new here, I find this site so full of information, how I'm confused.

Today I went and saw a lawyer because of the situation my fiancee and I have come into.

Back in September 2007 my now fiancee came to visit. She was due to stay until december 2007

and then return to canada however for her birthday, I proposed to her. When her family

heard about it, they threw her stuff out and stopped talking to her. They also refused to

pay for the return ticket as they were set to do when she came down here.

Fastfoward to now, we just got married last week however she's been here all that time.

We went to see a lawyer (finally could afford it!) and he told us that although we went about this the wrong way, that they should forgive because were applying as an immedieate relative

however if she leaves the us and returned to canada before the process was complete she'd be banned for 10 years.

I guess my questions is, does this seem right? I know it's our fault for not taking care of it

sooner however we didn't have the means for her to return or to file. As many others, I

don't want to loose her.

The lawyer told us to submit applications for I-130 & I-485 right away and if the question

of the overstay came up in the interview to explain the extreme hardship of money and

everything should be okay.

And sorry two more quick questions

We were starting to fill out the forms today and saw on I-485 that they want a copy of her

passport and I-94. Being Canadian, she has no stamp in her passport or an I-94. Do I send

a letter explaining that or what?

Yes, the attorney's advice seems correct. I'm not certain how Canadians handle the lack of an I-94.

Facts are cheap...knowing how to use them is precious...

My lawyer gave the same advise. Everything yours said is correct.

On the I-94 part...my lawyer told them IF there was one it was destroyed. This was in the same sentence that I washed his Canadian Passport :) oops! So on ours you can't even read his entry stamp without a copy machine that prints DARK!

He wrote that on the cover letter (I forget the right term for that:)) I know I have read somewhere on these forums all kinds of different things people from Canada say. "Came as visitor, no I-94 issued" and such things.

10/14/2008 - Gave lawyer all necessary documents.

11/10/2008 - Got word from Lawyer that paperwork is final and to come in on the 12th to sign and send!

11/12/2008 - Signed all documents and the check! Lawyer mailing out packet this week!!!
