NA02 Sent, I got laid off:((((

Hello all, this is my situation.

Today I recieved an email that my aproval notice has been mailed (na02 )

WHOHOOOOOOOOOOOOOOOOO :star::star::dance::dance:

BUT! I got laid off last week my most recent paystup is from December26 and I got a letter from my employer stating that I am employed with my company on November 21....

My question is....Can I sent those documents for proof of income or would I need a more recent letter from my employer

Documents Sent I-129f on Oct13

Noa2 sent on January 14.

Please help :crying::crying:

I wouldn't lie about employment. If your aren't employed but are submitted old documents that say you are you could end up with some problems.

Hurry and find a new job

My belle was working at one place when we started the process, and by the time the NOA2 came she had quit that job and was working at a new place. It never was an issue, they didn't even inquire about it.

But ya, don't lie and try to use these documents to convince them that you are employed when you no longer are. You could get away with it, but get caught and be ready for PAIN.

I know....I dont want to lie about it it just that I just got laid off and no interviews yet...Im very conserned and my paystub is very recent since I got laid off last week.....Of course best option would be to find a job but I don't know if I will....and another thing I just filled for unemployment, I don't know if they will figure out that I am reciving it....I DONT KNOW WHAT TO DO>..........(

When you file taxes for 2008 are you going to be over 125% of the poverty guidelines?

What are the chances you can get a co-sponser?

If you cant find a job before your interview you will probably need a cosponser.

If you get a job and your last years income and your then present income show the ability to support your fiance you may not need a sponser.

At this point it would be good to line up a sponser just in case.

Unfortunately, depending on where you live, it may be impossible to hurry up and find a job in this economy.

You are right it is very hard to find a job, I live in Northern California and its crazy I send about 10 resumes a day and no luck a day. Do they paystubs need to be close to the interview or can I send them right now since I recived the NA02 TODAY???

For 2008 I will be over poverty level.....

you should take any job you can get right now before your unemployment kicks in .

If you are unsure about how quickly you can find another job, can you try and find a co-sponsor?

Also you will need to show again that you are able to support your fiancée during AOS. You will need new proof again.

Ofcourse by the time AOS hits I oboulsy will have to be employed.........but thats at leaast 4 -6 month I will have more time to find a job....Its a bad time to loose a job with the economy and all but what can you do.......

First...relax a bit. Your interview is 2-3 months away, start looking for a job.

Unemployment COUNTS as income, do not worry about filing for it, file for it today. There is NO REQUIREMENT you be employed at all, only that you have income, unemployment is income (that is why you claim it on INCOME TAX) I checked, if I were unemployed today, my weekly benefit would be $452...$23,500 per year, enough for a family of 3.

DO NOT attach that employment letter to your I-134!!! If you do, it is a lie and will bar you for 3 years. There is NO REASON to lie.

Attach your 2008 tax return AND 2007 and 2006. Attach a bank letter. State your "current income" from unemployment if that is the case at the time, your last three years income and your assets if you like. Attach a bank letter. I don't see where you will have a problem unless you have been making "borderline" income for the last 3 years, in which case the USCIS is the least of your problems, you have a real life to live with a new wife and (maybe) children. If your fiancee doesn't have children now, and she is Ukrainian, she will want them SOON. She will arrive and want to start driving and then want a car. Really, this 125% of poverty thing is nothing. You have real troubles if you aren't 400% of poverty level, forget the USCIS, life is scary enough!!!!!

See if you can line up a co-sponsor also, if it turns out to be needed.

Kiev calculates it this way...

1. CURRENT income (even unemployment benefits) If this is enough, you are in...period. There are no "degrees" of acceptance, it is simple "pass/fail" $1 more than the cut-off is as good as $1,000,000 more.

2. Average of past three years, same standard.

3. Assets. You will be "credited" $1 for every $5 of assets

4. Co-sponsor

So....put aside your worries about the I-134 and what they will see on it. Go out there, today if possible, and get a job. Almost any job will do. The income qulaifications for the AOS are exactly the same, so do not worry about that. The income qualifications for LIFE are far higher...concern yourself with THAT.

are you sure about all that?? we have a similar problem. my fiancee got layed off. she already have a new job, but we don´t know if she meets the poverty line requirements...

next question for me... what income does count as the income? adjusted gross income? net income? does child support count? does unemployment really count?

i´m very worried atm....

I just called uscis and they said that as long as I meet the requrments for being above poverty line it does not matter if im employed or unemployed as long as the amout is right........???? IS THAT TRUE?!?!? I hope it is :) ( I currently got the Unemoloyment that way acceeds the poverty line )
