That was before my medical expires...Then, I am thinking to submitt the AOS after our 2nd year wedding anniversary this coming febuary...Is it ok to do that? My concern is the I-693 not to submitt it right away...(btw, my visa is valid till next year). thank you.. :help:

Why are you waiting until after your 2nd anniversary? If it is to assure a 10 yr GC, then you are probably already there since it is highly unlikely your GC would be issued prior to your 2nd anniversary (Rin and I married 10/09/2006; K3 visa 04/17/2007; filed AOS 06/20/2008; AOS approved 11/20/2008 - 10 yr GC). Had it been issued prior to our 2nd anniversary, it would have been for 2 yrs.

John

p.s. The medical requirements are that the AOS has to be filed within one year of the exam date. Rin's wasn't, so she had to get a second exam. The children's were, so they did not.

From the I-693 instructions, Section III - FAQ:

2. What if I am a K nonimmigrant visa holder and

already had a medical exam overseas?

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e), or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3

spouse of a U.S. citizen, and

C. You received a medical examination prior to

admission, then-

a. You are not required to have another medical

examination as long as your Form I-485,

Application to Register Permanent Residence or

Adjust Status, is filed within one year of your

overseas medical examination.

b. You will, however, be required to complete Part

1, Information about you, and submit the

vaccination section of Part 2 with your

adjustment of status application. A designated

civil surgeon must complete the vaccination

section and Part 5, the Civil Surgeon's

Certification.

If you do not file prior to the anniversary of your medical exam for the K-3 visa, then you will need a second exam.

I also suggest sending in your I-485 (AOS) at least a week or two before the one year expiration of your medical to give the USCIS time to receipt the package.

It is very unlikely you will get an interview at the Chicago office in less than 90 days.
