Timeline

Hi guys,

First i am gonna file for my N400 in end this month,So do i need to wait for W2 to file taxes for 2008?or just go head and send last 3 years (2005,2006,2007)?

Last time when i filed for remove condition,i didn't send 2007 taxes,than i got RFE,i don't know if is gonna be some case or not for N400?

I appreciate any advance.

If I were you, I will write cover letter to explain that Tax Year 2008 is not filed yet, and you will bring it to interview when it is done.

Also include last three tax return - 2007, 2006, 2005 - along with your 3 or 6 month pay stub copy.

If possible, you should get Employment verification letter from your employer to state your job position, employment period, full/part time, and yearly salary info.

Your pay stub should show year-to-date salary info to back up your employer's statement for yearly salary info.

In order to collect W-2 and other 1099/1098 forms, it will be easily delayed another month or so.

I wouldnt worry about it. You should be fine with sending those years in . Taxes are not due until April, so they are not going to expect you to file your taxes just because your applying for your citizenship. Plus the federal deadline to send out w-2s is Jan 31st.

I personally don't think you need to send in your paystubs or get a letter from your employer. Your taxes returns or transcripts should serve as proof that you have paid your taxes on time. Your trying to establish good moral character and/or you are still married to your US spouse and that your marriage is not a sham and your filing jointly.

No offense moonhunt but I think sending in paystubs and getting a letter of employment verification is a total waste of time. The USCIS only wants to know that he as paid his taxes on time in the past and since he is applying way before taxes are due, I don't think they are going to question why he did not send his 2008.

Just my 2 cents. Good luck with your process.

We were March filers, that gave me all of February to get our taxes done, and law requires that you get in all of your tax information, W2's, interest, 1099's etc by January 31. RFE with the N-400 can cause major delays, and they have a bug on tax returns, least with us, may be better to wait a couple of weeks.
