Forgive me if this information is on the forums somewhere already. If so, I haven't found it...

I am an American man who married a Brazilian woman in Brazil in December, 2008 (the wedding and party were amazing...wish you all could have been there!). She has two children from a previous marriage. All three already have valid visas to enter the United States: she has a B1/B2, the kids have tourist visas.

Will they be able to enter the USA on their existing visas after I begin filing our paperwork? They are scheduled to visit the states for a couple of weeks in February, but I am concerned that there will be problems if I begin the immigration process before they arrive.

So, does initiating the paperwork for their immigration invalidate (or otherwise complicate) their pre-existing visas, or will they be able to continue traveling on them while the process is underway?

Thanks for any feedback,

David

It is permissable to have more than one visa in different visa classes at a time

It is possible that they could be turned away at the POE if it was suspected that she was coming here with the intention of not leaving.

However with the processing times being what they are you dont have to worry about her visa being approved by february so you might as well file and get started.
